618ORDINANCE NO. 618 AN ORDINANCE DEFINING THE OCCUPATION OR BUSINESS OF "SPECULATIVE BUILDER"; PROVIDING FOR THE LICENSING OF PERSONS, FIRMS AND CORPORATIONS ENGAGED IN THE ?. BUSINESS OR OCCUPATION OF "SPECULATIVE BUILDER" WITHIN THE CITY OF CLEARWATER, FLORIDA; FIXING THE ` AMOUNT OF THE OCCUPATIONAL LICENSE TAX TO BE PAID BY ' "SPECULATIVE BUILDERS" WITHIN TIfE CITY OF CLEARWATER, FLORIDA; PROVIDING FOR THE MANNER AND CONDITION OF THE ISSUANCE OF SUCH LICENSES; PROVIDING A PEx+IALTY FOR e: : 11 ?' ?S f''?,'\?. f, ?:; '_'{, .. V , f'.' f gip'..., FAILURE TO COMPLY THER1EgITH; A14D PROVIDING THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEAMIATER, FLORIDA: SECTIO14 I. DEFINITION. -- Any and all persons, fixms, or corporations who shall, within the territorial limits of the City of Clearwater, Florida, undertake to erect, construct, or build any building or structure or buildings or structures, without retaining the services of a licensed general contractor, for the purpose of selling or offering the same for sale at a profit, are hereby defined and held to be "SPECULATIVE BUILDERST, within the meaning of this Ordinance. € SECTION II. No person, firm, or corporation shall engage in or manage the business or occupation of "SPECULATIVE BUILDER" within the City of Clearwater, Florida, unless a City license shall be issued to each such person or persons on receipt aL of the amount hereinafter stated, which receipt shall be signed by the City Treasurer amd Tax Collector, and shall have the City seal affixed thereto. SECTION III. On and after the effective date of this Ordinance on Annual Occupational License tax in the amount of $100.00 shall be assessed and collected from any and all persons, firms, and corporations who shall within the territorial limits of the City of Clearwater, Florida, engage in the business or occupation of "SPECULA- TIME BUILDER" as defined in this Ordinance. SECTION IV. The License tax hereby ordained for the fiscal year 1951-52 shall be due and payable within ten days after the effective date of this Ordinance, and all other License taxes hereby ordained shall be due and payable on the first day of October of each year and if not paid within 30 days after the due date thereof, the same shall be considered in default and subject to a 5% penalty, and it shall be and is hereby made the duty of the City Manager to make Affidavit for the arrest of any person failing or refusing to pay the same, and to cause such person to be brought before the Municipal Court for trial. SECTION V. The right to revoke any License issued under the provisions of this Ordinance for cause is reserved to the City of Clearwater, and said revocation shall be made at the direction of the City Commission. SECTION VI. PRIMA FACIE EVIDENCE. - Proof of the building and selling of buildings and offering for sale within the City of Clearwater, Florida, of two or more buildings or structures within any one License year of said City without retaining the services of a licensed general contractor shall be deemed to be prima facie evidence that the person, firm, or corporation so doing is engaged in the business or occupation of "SPECULATIVE BUILDER" within the meaning of this Ordinance. SECTION VII. Any person or persons, firms, or corporations or associations that shall carry on or conduct the business or occupation of "SPECULATIVE BUILDER" for which a license is hereby required, without first obtaining such license, shall upon conviction be punished by a fine of not more than $200.00 or be imprisoned for not more than 60 days or both. SECTION VIII. All Ordinances and parts of Ordinances in conflict herewith are hereby rapealed. SECTION IX. This Ordinances shall become effective immediately upon its passage and adoption by the City Commission of the City of Clearwater, Florida, and its publica- tion by title as is provided by law.
