BE IT ORDAINED by the City Commission of the City of Clearwater, Florida. SECTION 1. It shall be unlawful for any person, association of persons, or corporation, or any agent or employee of any person, or association of persons, or association of persons, or corporation', to manufacture, sell., exchange or cause to be manufactured, sold or exchanged or in any wise to be concerned in the manufacture sale or exchange, or to transport or cause to be transported, or in any wise to be concerned in the trans- portation or, or to possess or have in possession, either actual or constructive, in the City of Clearwater, Florida, any alcoholic or intoxicating liquors or beverages, whether spirituous, vinous or malt,provided however, that nothing in this ordinance shall be construed to prohibit the manufacture, use, sale, transportation or possession of alcohol, wine, or•other spirituous, vinous or malt beverages where such manufacture, use, sale, transportation or possession is licensed or permitted by the laws of the United States of America and/or the State of Florida. Nothing in this Ordinance shall be construed to prohibit the City of Clearwater from lawfully apprehending and punishing or penalizing any person, association of persons, or corporation where such person, association of •bersons, or corporation is violating or has violated within the City of Clearwater any law or laws of the United States of America or the State of Florida, pertaining to intoxicating beverages whether such act of violation is included within this ordinance or not. Any person or persons found guilty of violating tho provisions of this ordinance shall be punished by a fans of not more than $500.00 or by imprisonment for a period or not more than six months, or by both such fine and imprisonment, at: the discretion of the Municipal Judge. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. This Ordinance shall take effect from and after its passage.
