Being Entitled "An Ordinance to authorize the Execution of
the Contract between the City of Clearwater, Florida, and the
Atlantic Coast Line Railroad Company, a corporation under the laws
of the State of Virginia, in reference to the Extensdon of Court
Street in the City of Clearwater, Florida." ____,..._.....
WHEREAS, The City of Clearwater , Florida, desires the
Atlantic Coast Line Railroad Company to dedicate to the City of
Clearwater for street purposes, a strip of land one hundred (100)
• feet wide over and across the right of way and tracks of the
Atlantic Coast Line Railroad Company where said right of way and
track intersects the proposed extension of Court Street, as defined
on a certain map duly recorded in the public records of Pinellas,
County, Florida , in Plat Book ?.5?. page 53 and
WHEREAS, The Atlantic Coast Linn Railroad Company is will-

ing to dedicate said strip of land for street purposes only upon
the following conditions; I
lat. That the said City of Clearwater shall pay all cost ,

of grading, paving and curbing said street over addocross the right
of way and, tracks of the Atlantic Coast Linn Railroad Company.
2nd. And shall pay all costs of placing planking between the
tracks and on each side of the tracks of the said Atlantic Coast
Line Railroad Company as provided by the ordinances of said City.
3rd . And shall pay all costa of constructing and paving
sidewalks over and across the right of way and tracks of the
Atlantic Coast Line Railroad Company.
4th. That the said City of Clearwater shall not assess any
portion of the cost of said work against any of the property of the
Atl tic Coast Line Ra11road P^" an

5th. That after the completion of said work the said city '
of Clearwater shall. perpetually pay all costs of maintaining said '
work and paving over the right of way and tracks of the said

6th. That the said City of Clearwater shall not by
ordinance or resolution or in any other way compel the Atlantic
Coast Line Railroad Company, at its expense, to lower the grade of
its tracks as now constructed over the strip of lend herein
mentioned and descibed. {

THERFFORE , HE IT ORDAINED BY THE CITY COU14CIL OF THE ,
CITY OP CLEARWATER , FLORIDA:
Section 1 . Upon the execution and delivery of a deed
from the Atlantic Coast Line Railroad Company to the City of Clear-

the Atlantic Coast Line Railroad Company, require the lowering of
