133 ORDIN-ANM, NO. 133 OF THE TOWN OF CLEARWATER, FLORIDA. An Ordinance, Entitled "An Ordinance Creating A Board of Health, f A Sanitary And Food Inspector To Be Known As The Health Officer, To Provide For His Compensation, And To Prescribe The Duties And Powers Of The Board Of Health And Health Officer." 1 Be It Ordained by the Town Council of the Town of Clearwater, Florida: Section 1. That there is hereby created and established for the ! ' Town of Clearwater, a Board of Health, as a Department of the Town t Government of said Town. One member of said Board of Health shall . be designated by the Mayor and Town Council'as the Health Officer of said Town, who shall be the Sanitary and Food Inspector for said ? 111 f t Town. The Board of Health shall consist of the Mayor, the Chairman :. of.the Sanitary and Sewers Co=dttee of the Town Council, and three others to be elected by the Town Council, at least one of whom ? shall be a practicing physician living within said Town. At the „. time of the election of the members of said Board of Health, one of them shall be designated as the Health Officer of said Town. The terms of office of the said Board of H©alth and Health Officer shall be two years, provided, that the team of office of all members thereof shall and on the first Monday after each general election ?. 1held in said Town for the election of Mayor, Provided, the said I Board of Health and Health Officer shall hold office until their successors are duly qualified. 1 Sec. 2. Before entering upon their respective duties, tho i members of said Board of Health Shell subscribe to the oath of office. in substantially the same form as prescribed for other officers of the Town of Clearwater. Sea. 3. The Board of Health and Health-Officer shall perform such duties and exercise such powers as may be prescribed or con- ferred'upon them by the Charter and Ordinances of the Town of Clear- t crater. It shall be the duty of the Board of Health to hold i such regular or special meetings as it may deem necessary; to make such rules and regulations-for its goverment and for the improve- ment of the sanitary conditions and for the protection of the pub- lie health, not inconsistent with the ordinances of the Town, as it may deem best; and to prepare and submit to the Town Council i such ordinances as it may deem necessary and expedient to improve the health and sanitary conditions of the Town, and for the pre- vention of unhealthful and unsanitary conditions in said Town, not inconsistent with the Laws of the State of Florida and the rules and regulations of the State Board of Health. Sec. 6. When any person cominG from abroad or residing in s _ said'Towrn, is, or lately has been, infected with smallpox, cholera, diphtheria, scarlet fever, yellow fever, or any other contagious disease, dangerous to the public health, the board of Health may s sp , an w a o 8 inmates be quarantined as provided for by the ordinances of the Town and the rules and regulations of the Board of Health. Sec. 7. The Health Officer shall examine into all nuisances, souroes of filth, and causes of sickness or opidemics, and shall make immediate report to the Board of Health, who shall make such . '7 regulations and orders respecting the same as they may judge ne- cessary and expedient for the public health and safety of the in- habitants.9. And when any nuisance, source of filth, or cause of sickness is found on private property, the Health Officer shall s.. order the owner or occupant thereof at his own expense to remove or abate the same within three hours; and whenever-such owner or E" •.' Sec. 8. Whenever the Health Officer shall deem it necessary, he shall have the right to enter any building or premises in said Town for the purpose of examining into and destroying, removing " +. '. or preventing any nuisance, source of filth, or cause of sickness. And if he, or any authorized agent of the City Board of Health, shall be prevented by any person from entering such building or premises, auohLperson upon trial and conviction therefor may be punished by a fine not exceeding Two Hundred Dollars, or by im- prisonment in the Town Jail, or at labor upon the streets or other public works of the Town,not exceeding ninety days, or by both such fine and imprisonment at the discretion of the Mayor. Sea. 9. When any person, firm or corporation shall be dis-r aatisfied with any decision, order or official act of the Health Officor, they shall have the right within three hours thereafter` ' to appeal to the Board of Health of said Town; and the Board of Health shall hear the matter at the earliest possible time, at'` whibh hearing the party aggrieved shall have the right to appear ' before the said Board of Health, in person or by counsel, and shall have the right to produce such evidence as they may deem necessary; ' and the decision and order made therein after such hearing, by the . The Town Clork shall'be the Secretary of the Board of ' Health, and shall keep a record of all the official acts and orders ' w' ' :'•:!
