Be it ordained by the Town Council of the Town of Clearwater: Section 1. That the peninsular Telephone Company, a torpor- ation organized and doing busineso candor the laws of the State. of { Florida, with its principal office located in the City of Tampa, ' Florida, be, and it, its successors and assigns are hereby granted the right, privilege and franchise for the period of twenty (20) f... Veers from the date hereof, to construct, maintain and operate within the limits of the Town of Clearwater, as the same now exists or may be hereafter extended, a telephone system for the public and private use: to set poles, string wires and lay conduits along, over and all of the streets, alleys and avenues of the said town, with the privilege of charging tall, rent and hire for the use of its tele;- phones and lines or other instruments; provided that, except distributing poles and wires, and poles and wires required for the F ' operation of toll lines, the said company shall within two(2) years install its wires and cables underground along Fort Harrison f `'. Avenue between Haven Avenue and Drew Avenue, and along Cleveland { Street from the Atlantic Coast Line Railroad Company's Tracks west, provided that when any additional cables may become necessary on {• any of the streets of the Town of Clearwater, they shall be ?. constructed under ground, and it is further provided that all poles .,c +. shall be placed and conduits shall be constructed under the super- . ,.. t .. The rate to continue ' until the service of the Exchange in the Town of Clearwater shall have increased to five hp.ndred (500) telephones, and thereafter the rata shall become subject to further reasonable regulation by agbee-- + ment between the Company and this Council; provided, however, that i3 the rate provisions of this ordinance are without prejudice to the rights of either the company or the Town of Clearwater to invoke the regulation thereof by the Railroad Coi=ission or other authority duly authorized by law to regulate the same at any time, but the rates shall remain as fixed by this ordinance until, changed by agreement between the said company and the Town of Clearwater ` unless fixed by such authority. Section III. That at, the expiration of this franchise the Town of Clearwater shall have the right to purchase the telephone system installed and operated under this grant, as well, as all property used by it in the operation of said telephone system within the limits of the Town of Clearwater, as well as all other property used, under or in connection with this franchise or bight, or such part of said property as the said tovm of Clearwater may desire to = '. purchase, at a valuation of such property desired to be purchased to be fixed b a arbit ati be o id d b l pr y r on s may e y v my. .
