E% ORDINANCE NO. 2053 1'+Sia..Ir AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ARTICLE XVIII, APPENDIX A, ZONING, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, RELATING TO PLANNED DEVELOPMENT, TO PROVIDE STANDARDS FOR A PLANNED RECREATIONAL INDUSTRIAL DISTRICT; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the current zoning code in force within the City of Clearwater, Florida, contains no standards to guide development which incorporates both recreational and other types of development together; and k i << i y .. a ?L.` .3 r.+?i?. S 1 WHEREAS, opportunity exists where the existence of proper guidelines would permit such development and also permit continuance of development consistent with the type of community that has been developing in Clearwater; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. General description. A. Purpose. The Planned Development Districts are created to provide optional methods of land development which encourage more imaginative solutions to design, enhanced land utilization and reduction of conflicts between land uses. Recreational Planned Develo ment RecPD 3. Commercial Planned Development (CPD);_ 4. Industrial- Planned Development (IPD);_and 5. Any combination of the above individual Planned Development Districts. C. Minimum Area Requirements. 1. Residential planned developments shall require a minimum of four (4) acres; however, if fifty (50) percent or more of an area to be zoned RPD is for renewal or rehabilitation purposes, then the city commission' may approve such RPD with less than four (4) acres in area. 2. Recreational five (25) acres. 3. Commercial and a4nr,?foraturing- industrial planned develop. ments shall require a minimum of forty (40) acres. 4. D. Features. 1. Residential areas thus established would be characterized by a unified building and site development program illustrat- ing greater flexibility in design with provisions for open space and recreation. Other complimentary land features, depending upon the size of the development may include areas for commercial, religious, educational and cultural activities; all of which are integrated into the total project. 2. Recreational planned developments may include public and private recreation and open space uses, including but not limited to golf courses, ball fields, tennis courts, -stadiums, club houBes_commercial _recreation facilities and their support functions designed and integrated with adjoining uses on a planned basis'. xnasu ?,riag..as??.o Sabi at oa.. 3. The advantages of the commercial and/or maactsasi?g industrial development are very similar to the RPD in respect to design flexibility, improved land utilization with complimentary functions and especially reduction of traffic movement problems. The manufacturing planned development shall net include refining or manufacture of petroleum products as prohibited in section 25.04 and section 26.44 (Ord. Requests for zoning for R4esidentiaIFlamed Ac?w•elcrp?er?t- w?+-C o?rat?rcr?a>r ?,r-ArSariu?fa?c#us?ing ?n• Planned Development Districts or any combination thereof. Said request shall he submitted to the city clerk as a normal zone request, but shall also include a site development master plan to be simultaneously submitted to the planning and zoning board. Such plan may designate subareas to be developed by phase. The master plan shall hereafter be referred to as "'the plan" and shall conform to the following requirements and information requested for the purpose of zoning as a "planned development". Section 18.05. The plan; prezoning stage, content and information on the plan or submittal documents. (8) In CPDA4-IPD, a market analysis may be required for supporting evidence of need for business and/or industrial uses. Section 18.06. Processing of the plan; prezoning, predevelop- ment stage. (Z) Such plan intent shall become effective and operative upon final approval by the city commission for planned unit development zoning. The city commission, upon granting RPD, RecPD, CPD or4"PD, or combination type zoning shall at that same public hearing determine any further public hearing or public meeting requirements involving the final plan adoption, or subplan adoption, if considered as independent units, or shall assign in lieu thereof, responsibility for administrative review of the final plan, or subplans, before official acceptance by the city commission at a public meet- ing. Such assignment action by the city commission at the prezoning public hearing eliminates an advertised public hearing on the final plan and thus overrules such procedure set out in section 1B. 07(3). The above public hearing requirement determination may be based upon the following criteria (but not limited thereto). All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any section, paragraph, sentence 'or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect immediately upon its passage.
