WHEREAS, it has been requested by B & P, Ltd., owner of certain
real property in Belieair Subdivision, in the City of Clearwater, Florida,
that the City of Clearwater, Florida, vacate certains alleys and right-of-
way; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said alleys and right-of-way are not necessary
nor required for municipal use and it is deemed to be to the best interest
and advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The alleys in Blocks 12 and 13, and the right-of-way of
Hamlet Avenue (2nd Avenue) lying between the South
right-of-way line of B Street and the South right-of-way
line of A Street, less the Seaboard Coast Line Railroad
right-of-way, all being in Belleair Subdivision, according
to the map or plat thereof as recorded in Plat Book 1, page
105 of the Public Records of Hillsborough County, Florida,
of which Pinellas County was formerly a part,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto by
law, excepting that the City of Clearwater hereby retains a drainage and
utility easement over the full-width of the North-South alley in said Block
13, Belleair Subdivision, for the installation and maintenance of any and
all public utilities thereon.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
