WHEREAS, it has been requested by Clearwater Point Land Company,
owner of certain real property in Bayside Shores Subdivision, in the Ci
of Clearwater, Florida, that the City of Clearwater, Florida, vacate ;ri`s?} !'`•

certain drainage and utility easements; and fr.

WHEREAS, after proper public notice and public hearing thereon, s r
the City Commission finds that said drainage and utility easements are not ,
necessary nor required for municipal use and it is deemed to be to the best
interest and advantage of the City and the general public that the same be
vacated;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The East 5.00 feet of Lots 9 and 18, and the West
5.00 feet of Lots 8 and 19, all in Block B, Bayside
Shores, according to the map or plat thereof as
recorded in Plat Book 58, pages 12 and 13, of the
Public Records of Pinellas County, Florida,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto by
law.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes,

after, owned by them, into the corporate limits of the City of Clearwater,
Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on August 2, 1979, voted
unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishing of
fire district classification and to prepare an ordinance to annex "said parcel
of real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on September 20, 1979, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said
real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEAR WATER, FLORIDA;
Section 1. After its evaluation of all evidence presented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Section 171, 044,
Florida Statutes, hereby annexes into the corporate limits of the City of
Clearwater, Florida, and redefines the boundary lines of said City so as

District No. 2.
Section 2. The City Commission hereby formally and according to

rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 4. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes, and Section 171.044,
Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and
a copy thereof being filed in the office of the Clerk of the Circuit Court of
Pinellas County, Florida. In accordance with Section 171.091, and Section
171.044, Florida Statutes, a certified copy shall be filed with the Department
of State of the State of Florida.
