COMPLYING WITH THE "LOCAL GOVERNMENT COMPRE- HENSIVE PLANNING ACT OF 1975" AS AMENDED; ADOPTING f'• ? : 4 .fah ?';.'` 'La' THE LAND USE ELEMENT AS PART OF THE COMPREHENSIVE f ; PLAN FOR THE ENTIRE CITY OF CLEARWATER FLORIDA; ADOPTING THE ATTACHED EXHIBIT AND MAP; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND r, `Y: °.,' `L'•+ PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE WHEREAS, all required referrals and coordination with the County, Region and State as provided for in Section 163. 3184, Florida Statutes , have been complied with; and r 'f 1 WHEREAS, the Pinellas County Planning Council, the Local Planning Agency for Pinellas County, held the hearing required by the Local Government Comprehensive Planning Act of 1975 relating to such land use plan on September 20, 1978; and WHEREAS, pursuant to Section 163. 3184, Florida Statutes, noticed public hearings relating to the land use plan were held on July 19, 1979, and August 2, 1)79, with each such hearing being held on a weekday after five o'clock P.M.; and WHEREAS, notices relating to such hearings were published on July 12, 1979, and July 26, 1979; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1- The land use element of the comprehensive plan as required by the "Local Government Comprehensive Planning Act of 197511, as amended, and as set forth in the attached exhibit, described as: Composite Exhibit A - Document entitled "Land Use", consisting of a table of contents sheet and sixty-six (66) pages in addition to a map, color coded, entitled "1995 Clearwater Tomorrow--The Clearwater Comprehensive Land Use Plan" is adopted in accordance with the "Local Government Comprehensive Planning Act of 197511, as amended, for the entire City of Clearwater, Florida. -1- 11/1/79 f?s'•..•it`r35?rc?Flsi? ...?.:._'r.J?'t? S. Highway 19, excluding the Dunedin Industrial Park; thence due North to Curlew Creek Road; thence due East to McMullen-Booth Road; thence due South approximately 5,400 feet to City-owned property; thence due East approximately 2, 200 feet; thence due South approximately 2, 200 feet to State Road 580; thence West and Southwest to McMullen-Booth Road; thence due South to the centerline of Alligator Creek; thence East along Alligator Creek and the southern shore of Alligator Lake and Arlie Drive to Cooper's Bayou and Upper Old Tampa Bay all the way to the Clearwater-Tampa City Limits and Pinellas-Hillsborough County limits; thence due South to the Courtney Campbell Causeway; thence Westerly, Southwesterly, and Southerly along the shoreline of Old Tampa Bay to Bellair Road extended; thence due West on Bellair Road to the Seaboard Coast Line Railroad tracks; thence due North to and along Ft. Harrison Avenue to D Street; thence due West approximately 150 feet; thence due North to B Street; thence due West to 4th Avenue; thence due North to A Street; thence due East to Ft. Harrison Avenue; thence due North to Watkins Street; thence due West to Waters Street; thence due North approximately 700 feet; thence West to the Intracoastal Waterway; thence South--Southwest approximately 6, 000 feet; thence due West to the Gulf of Mexico. Section 4. All required and optional elements and parts of the Comprehensive Plan as required or allowed by the "Local Government Comprehensive Planning Act of 19751t, as amended, which are set forth in the attached exhibit adopted herein, are hereby adopted as part of this ordinance. -2- ord. 11/1/79 79 Section 5. All development undertaken and all actions taken in regard to development orders, all land development regulations enacted or amended by the City of Clearwater shall be consistent with this Plan and such element and part thereof in regard to the land covered by this element and portions of the Comprehensive Plan as hereby adopted shall be consistent with this Plan and each element and part thereof. Section 6. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 7. All public hearings and public participation required pursuant to Section 163. 3184, Florida Statutes, has preceded the consideration of this ordinance. Section B. This ordinance is hereby adopted and shall be considered henceforth adopted for the purposes of Section 163.3184 (7), Florida Statutes, and shall become effective immediately upon its passage.
