AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING A PORTION OF TRACT C, MYRON A. SMITH'S
BAYVIEW SUBDIVISION AND LOT 4, BLOCK 6, MCMULLENIS
TOWN OF BAYVIEW SUBDIVISION, PINELLAS COUNTY,
FLORIDA, TOGETHER WITH ABUTTING RIGHT-OF-WAY
FOR COUNTY ROAD 31, INTO THE CORPORATE LIMITS
OF THE CITY OF CLEARWATER, FLORIDA, AND REDE-
FINDING THE BOUNDARY LINES OF THE CITY TO INCLUDE
SAID ADDITIONS ACCORDING TO THE PROVISIONS OF THE
CHARTER OF THE CITY OF CLEARWATER, FLORIDA,
AND THE LAWS OF FLORIDA; AFTER PROPER PUBLIC
NOTICE AND PUBLIC HEARING THEREON, ESTABLISHING
THE FIRE DISTRICT CLASSIFICATION FOR SAID
PROPERTY; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Ejnar S. Svensson and John S. McCune
and Mary E. McCune, his wife, requesting the City to annex certain parcel
of real estate described hereinafter, owned by them, into the corporate
limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on July 5, 1979, voted
unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishing of
fire district classifications and to prepare an ordinance to annex said parcels
of real estate into the corporate limits of the City of Clearwater in
accordance with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on August 16, 1979, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classifications for said
real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at a
proper public hearing, the City of Clearwater, acting by and through its
City Commission, by the authority and under the provisions of Section

171.044, Florida Statutes, hereby annexes into the corporate limits of the
City of Clearwater, Florida, and redefines the boundary lines of said City
so as to include the following described parcels of real property in Pinellas
County, Florida, and establishes fire district classification therefor:
Begin at the NE corner of Tract 1101 of Myron A.
Smith's Bayview Subdivision, as recorded in Plat Book
25, page 57, of the Public Records of Pinellas County,
Florida, thence S 67'29:05" W along the southerly line
of County Road 105.93 feet for P. O. B.; thence continue
S 67'29105' W along the Southerly line of County Road
160.0 feet to the NW corner of Tract "C"; thence S 21
06148" E along the Westerly line of said Tract "C", 94
feet; thence N 67'29105" E, 160.0 feet; thence N 21`06'
48" W, 94.0 feet to P. O. B., together with abutting
right-of-way for County Road 31.
AND
Lot 4 of Block 6 of McMullen' s Town of Bay View
Subdivision, as recorded in Plat Book 6, page 23 of the
Public Records of Hillsborough County, Florida, of
which Pinellas County was formerly a part, together
with abutting right-of-way for County Road 31.
The above described property is hereby designated Fire
District No. 2.
Section 2. The City Commission hereby formally and according to
law, accepts the dedication of all easements, streets, parks, plazas, places,
rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 4. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes, and Section 171.044,
Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and

Section 2. The City Commission hereby formally and according to

rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning
Director are directed to include acid set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 4. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes, and Section 171. 044,
Florida Statutes.
i Section 5. This ordinance shall beconne effective L-n-mediately upon
its passage and earoll-ment in the City of Clear-imter Ordinance Book and
a copy thereof being filed in the office of the Clerk of the Circuit Court of
