AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
REPEALING ORDINANCE NO. 1962 IN ITS ENTIRETY;
VACATING THE SOUTH THREE FEET OF A CERTAIN
UTILITY EASEMENT ON THE NORTH SIDE OF LOT 28,
UNIT 1, COUN'T'RYSIDE TRACT 8, PINELLAS COUNTY,
FLORIDA; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on August 16, 1979, the City Commission of the City
of Clearwater adopted Ordinance No. 1962, which vacated a portion of a
certain utility easement;,and
WHEREAS, it has now been determined that the legal description
of the area vacated therein contained an error and the ordinance should be
repealed; and
WHEREAS, it has been requested by Stan Shankis, owner of certain
real property in Unit 1, Countryside Tract 8, in the City of Clearwater,
Florida, that the City of Clearwater, Florida, vacate a portion of a
certain utility easement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that a certain portion of said utility easement is
not necessary nor required for municipal use and it is deemed to be to the
best interest and advantage of the City and the general public that the same
be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:,
Section 1. Ordinance No. 1962, which was adopted by the City
Commission of the City of Clearwater, Florida, on August 16, 1979,
is hereby repealed in its entirety.
Section 2. That the following:
The South 3 feet of the existing 10 foot utility easement on
the North side of Lot 28 of Unit 1, Countryside Tract 8,
according to the map or plat thereof as recorded in Plat
Book 78, pages 23 and 24 of the Public Records of Pinellas
County, Florida,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto by

Section 3, That the City Clerk is hereby directed to record this

Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
REPEALING ORDINANCE NO. 196Z IN ITS ENTIRETY;
VACATING THE SOUTH THREE FEET OF A CERTAIN
UTILITY EASEMENT ON THE NORTH SIDE OF LOT 28,
UNIT 1, COUNTRYSIDE TRACT 8, PINELLAS COUNTY,
FLORIDA; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on August 16, 1979, the City Commission of the City
of Clearwater adopted Ordinance No. 1962, which vacated a portion of a'
certain utility easement; and
WHEREAS, it hats now been determined that the legal description
of the area vacated therein contained an error and the ordinance should be
repealed; and
