ORDINANCE NOS 2008
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, VACATING A PORTION OF A CERTAIN
UTILITY EASEMENT IN COUNTRYSIDE TRACT 5,
PINELLAS COUNTY, FLORIDA; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, it has been requested by U. S. Home Corporation, owner
of certain real property in Countryside Tract 5 in the City of Clearwater,
Florida, that the City of Clearwater, Florida, vacate a portion of a certain
utility easement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of the utility easement is not
necessary nor required for municipal use and it is deemed to be to the beat
interest and advantage of the City and the general public that the same be
vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
South 2 feet of the existing 5 foot easement along the
North side of Lot 74, Countryside Tract 5, according
to the map or plat thereof as recorded in Plat Book
78, pages 57.and 58 of the Public Records of Pinellas
County, Florida, LESS the West 10 feet thereof,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations. entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.

Section 4. This ordinance shall become effective immediately upon
its passage.
