AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA
AMENDING THE CAPITAL IMPROVEMENT PROGRAM REPORT
AND BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER
1, 1978 AND ENDING SEPTEMBER 30, 1979; TO REFLECT AN
EXPENDITURE INCREASE OF $30, 000 TO PROVIDE FOR THE
HAVEN HOUSE RENOVATION PROGRAM, FUNDED THROUGH A
GENERAL FUND TRANSFER FROM THE OPERATING BUDGET TO THE CAPITAL IMPROVEMENT PROGRAM BUDGET; TO REFLECT
A RESTATEMENT OF RESOURCES APPROPRIATED AS RECORDED
IN CAPITAL IMPROVEMENT ORDINANCE NO. 1817• PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF, PROVIDING
FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE

WHEREAS, the Capital Improvement Program Report and Budget for
the fiscal year beginning October 1, 1978 and ending September 30, 1979, was
adopted in accordance with Section 2-78 of Ordinance No. 1665 and
Federal Revenue Sharing, by Ordinance No. 1817, amended by Ordinance 19+45;
and
WHEREAS, unanticipated needs necessitates the establishment of a budget
to provide for the Renovation of the Haven House in the amount of $30, 000; and
WHEREAS, a fund of $30, 000 will be available to finance this budget
through a General Fund transfer from the Operating Budget to the Capital
Improvement Program Budget; and
WHEREAS, Capital Improvement Ordinance No. 1817, Exhibit A,
Resources Appropriated for Capital Projects in 1978/79 is restated to
properly reflect sources of appropriations; and
WHEREAS, Section 2-78 of Ordinance No. 1665 authorizes
the City Commission to provide for the expenditures of moneys for proper
purposes not contained in the budget as originally adopted due to unforeseen
circumstances or emergencies arising during the fiscal year;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 1 of Ordinance No. 1817 is hereby amended to
read as follows:

"That the amended Capital Improvement Program Report and
Estimated Budget for the fiscal year bdginning October 1, 1978
and ending September 30, 1979, a copy of which is on file with
the City Clerk, is hereby received. Pursuant to that report,
the City Commission hereby adopts an amended- budget for capital
improvements for the City of Clearwater, a copy of which is
herewith attached and marked Exhibit A.'t
Section 2. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any Court to
be invalid, the same shall not affect the validity of the ordinance as a whole
or any part thereof, other than the part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed
to the extent of their conflict.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes. '
Section S. This ordinance shall become effective immediately upon
its passage.
