ORDINANCE NO. 1992
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1979, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PAR'I'S OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on July 5, 1979, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 197911, as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as RPD - Residential Planned Development with a
.? maximurn density per acre of 10.5 units.
A tract of land in the SW 1/4 of Section 17, Township Z8
South, Range 16 East, Clearwater, Pinellas County, Florida,
and being more particularly described as follows:
Commence at the SW corner of said SE 1/4; thence N 0.33'
3Z11W, along the East line of said SE 1/4, for 1213. 35 feet
to the P. O. B. of the following described parcel; thence N
003313211 W, along said East line, for 786.67 feet; thence
S 89"5011511 E, for 669.05 feet; thence S 89.5014211 E, for
356. 13 feet to an intersection with the Westerly right-of-way
of Countryside Boulevard; thence S 0.31' 501i E along said right-
of-way for 376.43 feet to a point of curvature of a curve concave
to the NW; thence Southwesterly along the are of said curve
having a radius of 1900.00 feet and a central angle of 16'061
4411 for 543.26 feet to a point of compound curvature of a curve
concave to the NW; thence Southwesterly and Northwesterly
along said right-of-way and along the arc of said curve having .
a radius of 25.00 feet and a central angle of 9104614711, for
40. 05 feet to the point of tangency, said point lying on the
Northerly right-of-way of Meadow Wood Drive; thence proceed
along said Northerly right-of-way for the following three (3)
courses: (1) N 72`3812341 W, for 196.08 feet to the point of
curvature of a curve concave to the SW; (2) thence North-
westerly along the arc of said curve having a radius of 1780.00

Section 22. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the .. •;;•'~ ;

Section 4. Any person, or persons, firm or corporation or association

of persons, who shall violate or fail to comply with any of the terms or

provisions of this ordinance shall, upon conviction, be fined not exceeding <
the sum of Five Hundred Dollars ($500.00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the
discretion of the J'udg'e. Each day that a violation is permitted to exist shall
constitute a separate offense.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
` i with Chapter 166. 041, Florida Statutes.
d Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
