AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, ;
VACATING CERTAIN UTILITY EASEMENTS IN OAK HILLS
PINELLAS COUNTY FLORIDA; PROVIDING
SUBDIVISION

FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.

WHEREAS, it has been requested by Warren F. McClelland, owner ;-`? '`•.`• {.

of certain real property in Oak Hills Subdivision in the City of Clearwater,
Florida, that the City of Clearwater, Florida, vacate certain utility
easements; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said easements are not necessary nor required
for municipal use and it is deemed to be to the best interest and advantage
of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
That all of the 5 foot easements lying along the South
and East sides of Lot 1; all of the 5 foot easements
lying along the North side of Lot 2 and along the East
side of Lot 2, legs the South 5 feet thereof; and the
5 foot easement lying along the West side of Lot 5,
less the South 5 feet thereof, all in Block "E", Oak
Hills Subdivision, according to the map or plat thereof
as recorded in Plat Book 7, page 66 of the Public
Records of Pinellas County, Florida,
be and the same are hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041,' Florida Statutes.
