AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 22, RELATING TO TRAFFIC, OF THE '
CODE OF ORDINANCES OF THE CITY OF CLEARWATER,
FLORIDA, 1962, TO CLARIFY THE PROCEDURE FOR ISSUING
WARNING LETTERS AND WARRANTS OF ARREST WHERE

WHEREAS, it is necessary to clarify the procedure utilized in
issuing warning letters and warrants of arrest where there are outstanding
parking violations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Section 126. 2, Notice upon failure to comply with notice
attached to vehicle, of Division 2, Parking Meters, of Chapter 22, Traffic,
of the Code of Ordinances of the City of Clearwater, Florida, 1962, is
hereby amended to read as follows%
Section 126.2 Notice upon failure to comply with notice
attached to vehicle.
If the violator of the provisions of this chapter pertaining to
stopping, standing or parking does not appear in response to a
notice or citation affixed to the motor vehicle pursuant to this
division within a period of forty-eight (48) hours, the clerk of
the court having jurisdiction of the subject matter shall following
the_expiration of an additional twenty-four (24) hour period pursuant
to Section 22-132 of the Code of Ordinance, send the owner of
the motor vehicle to which the notice or citation was affixed,
a warnin& letter informing 49m the registered owner of the
violation and the fact that the fine has doubled and warning 4Ani.

to Section 22-133 of the Code of Ordinances.
Section 2. Should any section. paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole,
or any part thereof, other than the part declared to be invalid.

Section 3. All ordinances or parts'of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed to
the extent of their conflict.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166, 0741, Florida Statutes.
Section 5. The-provisions of this ordinance shall take effect
immediately upon its passage.
