' ' BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 13-1, License required; contents; general w.*' regulations; penalty, of Article I, General and Miscellaneous Provisions, of Chapter 13, Licenses and Regulations, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is amended to enact a new subparagraph (h) to read as follows; (h) Definitions. (1) "Night Club" means a place reguarly operated for profit before or after the hours of midnight, where alcoholic beverages and/or food are served for consumption on the premises, and one or more forms of amusement are provided which may be included in the price of the food and beverage or both purchased by the patrons thereof. (2) "Tavern" means a place of business regularly operated for profit where alcoholic beverages are sold for consumption on the premises to partrons thereof, and where one or more forms of amusement may be provided. (3) "Restaurant" means any place whatsoever that is maintained and operated as a place where food is regularly prepared, served, or sold for immediate consumption on or in the vicinity of the premises. Section 2. That Section 13-7, Right to revoke or suspend and right to transfer, of Article I, General and Miscellaneous Provisions, of Chapter 13, Licenses and Regulations, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Ord. As used in this ara rah the term "nuisance" shall mean en a in in any activity or permitting any activity. or noise on the licensed premises including the real property _ associated with the licensed premise. such as repeatedly or intermittenly annoys disturbs, injures or tends to annoy, disturb, injure or endanger the comfort, repose, peace or safety of any person._ 2 The licensee engages in or permits disorderly or immoral conduct on the licensed premises. 3) The licensee causes or uermits the nlaving of anv form of music either b mechanical device or live erformance in such a manner that the sound is audible beyond the nrooerty line of the licensed oremises where the music is bei played or performed. -(4) The licensee repeatedly violates the Code of Ordinances of the City of Clearwater. (QThe licensee has violated an count ordinance state or federal statute or rule or regulation pertaining to the activity which has been licensed pursuant to this chapter (6The licensee fails to secure and maintain adequate offstreet parking facilities for use by patrons of the business premises. 7 The licensee fails to comply with the fire prevention ordinances of the City, after reasonable notice shall have been given to the licensee to eliminate or correct an condition in violation of such ordinances on the licensed remises. L8J Any person holding both a City license and a Pinellas County license for the same business shall have the City license automatically suspended in the event Pinellas County revokes or suspends the County license issued for such business. Following such automatic suspension, the City Commission shall establish a public hearing date at which time the holder of a City license that has been automatically suspended may appear and be heard as otherwise provided in this section with respect to whether or not such automatic suspension should become a suspension or revocation to . exist until such time as Pinellas County issues a new license. Except as otherwise provided herein, such City license shall be suspended or revoked only after notice being given to the licensee setting forth the grounds for such proposed action, and an opportunity for a public hearing at which the licensee and all others concerned shall have the right to: -2- 8/2179 6? i .xI•Y ?i'p .Jx.?SN ?.TE?'Yi •, i t 0xd. 1958 (•1-) (ELI Offer and examine witnesses and present evidence in support of their case; and (Z) b) Cross-examine witnesses and offer evidence to refute evidence offered in opposition. (4)-MExcept as otherwise provided herein, whenever any City license upon any premises in the City has been revoked pursuant to this section, no subsequent license or certificate of occupancy shall be issued by the City for the pre:nisee for a similar occupation or business or profession to that which has been revoked for a period of ninety (90) days subsequent to the effective date of the revocation unless the violation which caused the license to be revoked has been corrected. Except as otherwise provided herein, whenever any City license has been revoked or suspended by reason of the suspension or revocation of a Pinellas County license issued for such business, such suspension or revocation of the City license shall remain in effect until such time as a Pinellas County license is issued for such business. FQ}MLExcept in the case of a City license which has been suspended or revoked because of the suspension or revocation of a Pinellas County license, any City license which has been suspended in the manner provided herein, may be reissued following the expiration of the period of suspension which suspension period may not exceed sixty (60) days. (d) (JE Licenses issued by the City may be transferred with the approval of the city treasurer, subject, however, to the following conditions; (I) All business licenses may be transferred to a new owner when there is a bona fide sale of the business upon pay- ment of a transfer fee of _Three Dollars ($3. 00) and presentation of evidence of the sale and original license. (2) Upon written request and presentation of the original license, any license may be transferred from one location to another location in the same municipality upon payment of a transfer fee of _Three _Dollars ($3.00). Such transfers to be accomplished provided new location meets proper zoning criteria and only after completion of any neces sorry building and fire inspections. (3) Where the licensee has been exempted from payment of all or any part of the license tax therefor, any such license shall not be transferable under this section. Section 3. That Section 13-16, Schedule of Fees, of Article 1, General Ff 3!d •. and Miscellaneous Provisions, of Chapter 13, Licenses and Regulation's, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by amending Category (83) and Category (129. 1) and enacting a new Category (173.1) to read as follows; -3- Ord.'' #11958 8/2/79 wk i -A 1, ••..f1S:4 t.1. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other- than the part declared to be invalid. Section 6. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 7. The provisions of this ordinance shall take effect immediately upon its passage.
