CITY OF CLEARWATER, FLORIDA: :` }
Section 1. Section 23B-6, Designation of Investigating and Enforce-
meet Authority; Authority of Sanitation Division, of Chapter 23B, Lot
Clearing, of the Code of Ordinances of the City of Clearwater, Florida,
1962, is hereby amended to read as follows:
Section 23B-6. Designation of Investigating and Enforcement
Authority; Authority of Sanitation Division.
The Sanitation Division of the Utilities Department of the City
of Clearwater is hereby designated as the investigating and
enforcing authority pursuant to the provisions of this ordinance.
The Sanitation Division is hereby authorized and directed to
receive all complaints of a violation of this ordinance, make
inspections to determine if a violation of this ordinance exists,
gather all relevant information concerning said complaints,
conduct field investigations and inspections of real property,
and to enter upon real property in the conduct of its official
business pursuant to this ordinance. The Sanitation Division
shall also be responsible for providing all notices to affected
property owners required by this ordinance and to take such
other action as is reasonably necessary to accomplish the purpose
of this ordinance.
Section Z. Section 23B-7, Notice of violation and hearing, of
Chapter 23B, Lot Clearing, of the Code of Ordinances of the City: of
Clearwater, Florida, 1962, is hereby amended to read as follows:
Section 2313-7. Notice of violation and hearing.
Upon receipt of a complaint that said property is in violation
of this ordinance, and upon completion of the field investigation,
and failing to obtain voluntary compliance by the owner with this
ordinance, or upon field inspection by the inspector_ from the
Sanitation Division and upon failing to obtain voluntarv
compliance, the Sanitation Division shall make written demand
by certified mail, return receipt requested, directed to the
property owner as shown on the current tax roll of the County,
notifying such property owner that if the property is not cleared
within ten (10) days from the date of receipt by the owner of such

demand, that a hearing before the City Commission will be held
to authorize clearance of the property by the City. Such
notification shall include the time, date, and place at which the
hearing will be held, and an average estimate of the cost to clear
the property which would be incurred by the City. The hearing
shall be held not less than fifteen (15) days after receipt by the
affected property owner of the notice provided herein.
Section 3. Should any section, paragraph, sentence, phrase,
clause or other part or provision of this ordinance be declared by any
court to be Invalid, the same shall not affect the validity of the ordinance
as a whole, or any part thereof, other than the part declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are hereby repealed
to the extent of their conflict.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section b. The provisions of this ordinance shall take effect
immediately upon its passage.
