ORDINANCE NO, 1 3
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1979, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on April 19, 1979, the city Commission of the City of
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and 'The Zoning
Atlas of the City of Clearwater, Florida of 197911, as amended, is amended
to indicate that fact as hereinafter set out:
Zoned as RM-28 - High Density Multi-Family Use District
Commence at the NE corner of Section 30, Township 29
South, Range 15 East, Pinellas County, Florida; thence
N 89°04107'0 W along the North line of said Section 30 for
2293.45 feet to the point of intersection with the center line
of State Road 699 (Gulf Boulevard) as recorded in O. R. Book
1342, page 284 of the Public Records of Pinellas County,
Florida; thence S 31158120" W, 573. 24 feet to the point of
curvature of a curve concave to the Southeast; thence
S 58°0114011 E for 50 feet to the East right-of-way line of
State Road 699 also being the point of beginning for the herein
described parcel 4-1); thence N 31 °5812011 E along the East
right-of-way line of said State Road 699 for 148, 15 feet to a
point; thence S 89'04107" E 29. 18 feet to the East side of a
seawall and being the NE corner of said parcel 4-D; thence
Southwesterly along the East side of said seawall to the SE
corner of Parcel 4-D. From the NE corner of Parcel 4-D
S 31°581201' W 163.20 feet to the point of curvature of a non-
tangent curve concave to the SE with a radial line bearing

The North 1012. 54 feet of Government Lot One of Section
30, Township 29 South, Range 15 East being on Sand Key
and lying between the West right-of-way line of State Road
699 (Gulf Boulevard) as recorded in the Thatcher Right-of-
Way Deed (Book 1432, page 284) on the East and on the West
by a sheet pile seawall line as recorded in Disclaimer
#25586 of the Official Record 4370, page 2081 and 2082 of
the Public Records of Pinellas County, Florida.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. Any person, or persons, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500, 00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the
discretion of the Judge. Each day that a violation is permitted to exist shall
constitute a separate offense.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes,

and show upon the official zoning atlas of the City of Clearwater the foregoing
