AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARW'ATER, FLORIDA, 1979, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.

WHEREAS, on April 5, 1979, the City Commission of the City of ?? t?'•?_._ ? ? ?" a
Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas
of the City of Clearwater, Florida of 197911, as amended, is amended to
indicate that fact as hereinafter set out:
Zoned as CG - General Bus9.ness
o an e 1q. 1/Z o vacs e a ley, Block 4, Wallace's
Addition to Clearwater, Florida, according to the map or
plat thereof as recorded in Plat Book 3, page 6 of the Public
Records of Hillsborough County, Florida, of which Pinellas
County was formerly a part, AND ALSO that part of that
certain alley way running North and South which abuts Lot
3, Block 4 and further described as begin at the NW corner
of Lot 3, Block 4, and run South 151. 5 feet to the SW corner
of Lot 3; thence West 10 feet to the East boundary of Lot 6;
thence North 151. 5 feet to the South boundary of Street;
thence East to P. O. B., Block 4, Wallace's Addition to
Clearwater.
AND
East 50 feet of Lots 4 and 5, Block 4, Wallace's Addition
to Clearwater, Florida, according to the map or plat thereof
as recorded in Plat Book 3, page 6 of the Public Records of
Hillsborough County, Florida, of which Pinellas County was
formerly a part.

Section 22. All ordinances or parts of ordinances in conflict herewith

Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the W
part declared to be invalid.
Section 4. Any person, or persona, firm or corporation or association
of persons, who shall violate or fail to comply with any of the terms or
provisions of this ordinance shall, upon conviction, be fined not exceeding
the sum of Five Hundred Dollars ($500. 00), or imprisonment in Jail for not
exceeding sixty (60) days or by both such fine and imprisonment in the discretion
of the Judge. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out.
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING A PORTION OF SECTION 19, TOWNSHIP 29
SOUTH, RANGE 16 EAST, PINELLAS COUNTY, FLORIDA,
INTO THE CORPORATE LIMITS OF THE CITY OF CLEAR-
WATER, FLORIDA, AND REDEFINING THE BOUNDARY
LINES OF THE CITY TO INCLUDE SAID ADDITION
ACCORDING TO THE PROVISIONS OF THE CHARTER
OF THE CITY OF CLEARWATER, FLORIDA, AND THE
LAWS OF FLORIDA; AFTER PROPER PUBLIC NOTICE
AND PUBLIC HEARING THEREON, ESTABLISHING THE
FIRE DISTRICT CLASSIFICATION FOR SAID PROPERTY;
PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE

WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Chateau Wood Land Trust requesting the
City to annex a certain parcel of real estate described hereinafter, owned
by it, into the corporate limits of the City of Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on February 1, 1979, voted
unanimously to accept said request and authorized the proper officials to
set up a public hearing thereon for the determination and establishing of
fire district classifications and to prepare an ordinance to annex said parcel
of real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on March 15, 1979, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said
real property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at a proper
public hearing, the City of Clearwater, acting by and through its City
Commission, by the authority and under the provisions of Chapter 171.044,
Florida Statutes, hereby annexes into the corporate limits of the City of
Clearwater, Florida, and redefines the boundary lines of said City so as
to include the following described parcel of real property in Pinellas
County, Florida, and establishes fire district classification therefor:

the Southerly right-of-way line of the said Nursery Road;
thence along the said right-of-way line N 89°09104" W,
15.00 feet to a P. 0. B.; thence run S 00°51106" W, 639.86

E, 448. 59 feet; thence S 89'09'04" E, 365.79 feet; thence
N 00°51'06'1 E, 190.00 feet to a point along the said Southerly

The above described property is hereby designated Fire
District No. 2.
Section 2. The City Commission hereby formally and according to
law, accepts the dedication of all easements, streets, parks, plazas, places,
rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 3. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 4, This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Chapter 166. 041, Florida Statutes, and Chapter 171. 044,
Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and
a copy thereof being filed in the office of the Clerk of the Circuit Court of
Pinellas County, Florida. In accordance with Chapter 171. 091, and Chapter
171.044, Florida Statutes, a certified copy shall be filed with the Department
of State of the State of Florida.
