ORDINANCE NO, 1902
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A CERTAIN DRAINAGE EASEMENT IN SECTION
32, TOWNSHIP 28 SOUTH, RANGE 16 EAST, PINELLAS
COUNTY, FLORIDA; PROVIDING MR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE or THIS ORDINANCE.
WHEREAS, it has been requested by Tom Chestnut, owner of certain
real property in Section 32, Township 28 South, Range 16 East, in the City
of Clearwater, Florida, that the City of Clearwater, Florida, vacate a certain
drainage casement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said drainage easement is not necessary nor
required for municipal use and it is deemed to be to the beat interest and
advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. That the following:
Drainage easement lying 10 feet each side of the following
described line, to wit: Start at the NE corner of the NW
1/4 of Section 32, Township 28 South, Range 16 East and
run S 89°4014511 W, 684.96 feet; thence S 20°4014511 W,
430. 10 feet for the P. O. B. ; thence continue S 20.40'4511 W,
104, 90 feet; thence run S 53° 1014511 W, 70. 0 feet for the
Point of Ending, ,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporatim s entitled thereto by
law.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041, Florida Statutes.
