ORDINANCE NO. 1900
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
REPEALING ORDINANCE NO. 1881 IN ITS ENTIRETY; VACATING
A CERTAIN ALLEY IN TURNERS SUBDIVISION NO. 3,
PINELLAS COUNTY, FLORIDA; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on February 1, 1979, the City Commission of the City of
Clearwater adopted Ordinance No. 1881, which vacated a certain alley; and
WHEREAS, it has now been determined that the legal description of
the alley vacated therein was incomplete and the ordinance should be repealed;
and
WHEREAS, it has been requested by Williams & Walker Ltd., owner
of certain real property in Turners Subdivision No. 3 in the City of Clearwater,
Florida, that the City of Clearwater, Florida, vacate a certain alley; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said alley is not necessary nor required
for municipal use and it is deemed to be to the beat interest and advantage
of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. Ordinance No. 1881 which was adopted by the City
Commission of the City of Clearwater, Florida, on February 1, 1979,
is hereby repealed in its entirety.
Section Z. That the following:
That certain alley adjacent to and North of Lots 1, 2,
3 and the East 50 feet of Lot 4, Block 8, Turners Subdivision
No. 3, according to the map or plat thereof as recorded in
Plat Book 1, page 53 of the Public Records of Hillsborough
County, Florida, of which Pinellas County was formerly
a part,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations entitled thereto by law,
excepting that the City of Clearwater hereby retains a drainage and utility
.easement the full width of said described real property for installation and
maintenance of any and all public utilities thereon.

Section 3. That the City Clerk is hereby directed•to record this
ordinance in the,Public Records of Pinellas County, Florida.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041, Florida Statutes.
Section 55. This ordinance shall become effective immediately upon
its passage.
