BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section i, Section 1 of Chapter 67-1209, Laws of Florida, 1967, set forth as Section 128 of the Clearwater City Code, 1962, pursuant to the provisions of Section 10. 01 of Ordinance No. 1830, is hereby repealed, and there is hereby enacted a new Chapter 23B, Lot Clearing, to read as follows; CHAPTER 23B - LOT CLEARING Section 23B-1. Authority; Short Title. (1) Pursuant to the authority granted by Article VIII, Section 2 (b), Florida Constitution as implemented by the Legislature under Section 166.011, Florida Statutes, known as the "Municipal Home Rule Powers Act", the City Commission of the City of Clearwater, Florida, hereby establishes a procedure whereby property, including parkways, located in the incorporated area of the City of Clearwater may be cleared of excessive growth of weeds or other plants or cleared of excessive accumulation of plant material or of debris, trash, junk or other noxious materials, (2) This ordinance shall be known as the City of Clearwater Lot Clearing Ordinance. -1- ?/xs/zs . s? 4 r• 1!V t ?.ft a°y e i t" i.G i ?" ? .???s?t"??,R?;isl?in';.s?'t-??;?'a':..ni?,a'?t1?:I':'?..?:? r '?'+? ?f... ;?,f;"a;,';' ,.?<e°?•;;. It is hereby declared, due to the population density of the City of Clearwater, Florida, that the excessive growth or accumulation of weeds, undergrowth and similar living or dead plant material, or the accumulation of debris, or other noxious materials upon property situated in the incorporated limits of the City of Clearwater, Florida, is contrary to the public health, safety and general welfare of the residents of the City of Clearwater in that such growth or accumulation creates a haven or breeding place for snakes, rats, rodents and other vermin of like or similar character, or creates a breeding place for mosquitoes, creates a fire hazard to adjacent properties or adversely affects and impairs the economic welfare of adjacent property, or creates a traffic hazard at road intersections within the City of Clearwater and by reason of such factors is hereby declared to be a public nuisance. It is, therefore, deemed to be in the best interest of the health, safety and general welfare of the citizens of the City of Clearwater that such growths or accumulations, whether they be in the nature of weeds or other forms of plant life or other materials, be removed in accordance with the following procedures. Section 23B-3. Definitions. (1) Commission shall mean the duly elected Commission of the City of Clearwater, Florida. (2) De artment shall mean the Sanitation Division of the Utilities Department of the City of Clearwater. (3) Authority shall mean the City Commission of the City of Clearwater, Florida. (4) Property shall mean any individuao platted parcel of real property or any portion thereof, as it is recorded in the Public Records of Pinellas County, Florida, whether or not said parcel is contiguous to any other platted parcel, or any individual parcel of real property described by metes and bounds in the Public Records of Pinellas County, Florida. (5) Excessive growth shall mean the growth of weeds or plants which are not cultivated or landscaped or regularly tended which reach a height in excess of twelve. (12) inches. (6) Owner shall mean the person, corporation, partnership, company, trust, estate or any combination of other business or legal entities, singular or plural, which is a record owner or owners as recorded on the current tax rolls of Pinellas County, Florida. (7) Debris shall mean material which is stored externally and is not otherwise covered and shall include, but not be limited to the following; discarded household items; inoperative or discarded machinery, automobiles or appliances, refuse, garbage, rubbish, trash or junk, used scrap or discarded lumber, pipe, steel, plumbing fixtures, insulation. and other building material, construction equipment, tanks, casks, cans, old refrigerators, barrels, boxes, drums, ,,.piping, glass, old iron, machinery, excelsior or plastic. k. #1894:' 3/1.5/79 MiNsp6mik 11 .' f .,A Section 23B-4. Prohibitions. ?il (1) No person, firm, partnership, corporation, trust or estate, nor any other b usiness entity, shall permit the' excessive growth or accumulation of weeds or other similar plant materials, or the accumulation of debris, which is unattended and which creates a haven and breeding place for snakes, rats, rodents, or other vermin of similar kind and character or which furnishes a breeding place for mosquitoes or which creates a fire hazard endangering nearby structures or other flammable materials, upon property situated in the incorporated territorial limits of the City of Clearwater. (2) No person, firm, corporation, trust or estate, nor any other business entity, shall permit the excessive growth, or accumulation of plant material or the accumulation of debris or other similar material upon property situated on . street right-of-way in the incorporated limits of the City of Clearwater, Florida, which condition creates' a traffic hazard either by pedestrian or motor traffic by obstructing the view of approaching traffic in any intersection or street in the incorporated limits of the City of Clearwater, (3) Any owner or lessee of developed property who removes or has removed from the property any hedges, tree trimmings, boxes, or other household items, shall have the same cut into lengths no longer than four feet (41) and deposited at the edge of the street in front of the property for regular pick up by City sanitation.trucks of the City of Clearwater on their regular days of pick up. Should the City refuse to pick up household items such as matresses, pieces of furniture, old refrigerators, which are too large to place into City sanitation trucks, itiwill, be the responsibility of the property owner or lessee to have an outside company or organization remove said items within ten (10) days or such owner or lessee will be issued a citation by the sanitation division of the City of Clearwater for allowing such material to cause a nuisance to the general neighborhood. Section 23B-5. Exemptions. The prohibitions contained in Section 23B-4 hereof shall not apply to the following; (1) Any lands within the incorporated area of the City which are over five (5) acres in area; (2) Wetlands and environmentally sensitive areas as designated in the adopted environmental management conservation plan; (3) Any parcel of land within the incorporated area of the City which is undeveloped and which is primarily in a natural state of vegetation, and which is not otherwise in violation of paragraphs (1), (2) and (3) of Section 23B-4 herein. -3- Ord::.#],894 3/X.5/,7?9 1 A 0 !f_i• ?R rL'IL:1?iT5T.e.rt'..: _ ••:JU ?'.C .r.._ ? ?_._.... 1.]?r 4.:r_.. ..? .. ?. r ..-. .? .. r?: Vii. na - I Y ' Section 23B-6. F..y. of Clearwater is hereby designated as the investigating and r e. t.'. enforcing authority pursuant to the provisions of this ordinance. i....; ..?'.: ,.•";; ::.,;..??,;,: The Sanitation Division is hereby authorized and directed to receive all complaints of a violation o £ this ordinance, gather all relevant information concerning said complaints, conduct field investigations and inspections of real property, and to enter upon real property in the conduct of its official business pursuant to this ordinance. Section 23B-7. Notice of violation and hearing. r RW: .? Upon receipt of a complaint that said property is in violation `•"i`'iy` "<` of this ordinance, and upon completion of the field investigation, r and failing to obtain voluntary compliance by the owner with this j ".• ordinance, the Sanitation Division shall make written demand by certified mall, return receipt requested, directed to the property= owner as shown on the current tax roll of the Coun ; ? ti•: ty, notifying ?. i such property owner that if the property is not cleared within t'. ten (10) days from the date of receipt by the owner of such demand, that a hearing before the City Commission will be held -rte to authorize clearance of the property by the City. Such • ?; notification shall include the time, date, and place at which the hearing will be held, and an average estimate of the cost to clear the property which would be incurred by the City. The hearing shall be held not less than fifteen (15) days after receipt-by the Y ' affected property owner of the notice provided herein. +•yi Section 23B-$. Hearing before the Ci Commission. The City Commission shall provide each property owner receiving notice of such hearing an opportunity to be heard by the Commission and to present evidence or testimony that the. subject property is not in violation of this ordinance. Each affected property owner shall have a right to be represented by counsel. Upon hearing all testimony and evidence concerning the alleged violation, the Commission shall determine whether or not said owner has violated the provisions of this ordinance and shall provide written notice of its determination to said owner. Section 2313-9. Powers of Ci Commission. r Upon conclusion of the hearing the City Commission shall have the power to find that the property is or is not in violation of this ordinance. With respect to property found to be in violation of this ordinance, the Commission shall have the following powers; (1) To authorize the clearance of the property by the City or its duly constituted agents. (2) To require payment by the owner of said property hereinafter set forth to defray the costs of investigation, inspection, and reinspection of the property, and expenses incurred to provide the notices required herein. Clearance of Property. , i ®R Upon authorization'of the City Commission that certain property found to be in violation of this ordinance shall be cleared, the Sanitation Divsion shall reinspect such property in order to z . 5 verify whether compliance with this ordinance has been achieved. r? If compliance has not been achieved, the Commission shall r` 10 cause the property to be cleared by the Sanitation Division of r4 i 'tz the Utilities Department or its duly authorized agents. Section 2313-11. Establishment of Lien. The City Commission is hereby authorized to assess against property which is cleared by, the Sanitation Division or its agents pursuant to this ordinance, the actual coat to the City of clearing said property. The City Commission is further authorized to assess against the property found to be in violation of this ordinance administrative costs, pursuant to the authority granted by Section 23B-9 herein. Said actual cost of clearance plus such administrative costs shall constitute a lien against said property. A notice of-lien in such form as the City Commission shall determine may be filed in the office of the Clerk of the Circuit Court of Pinellas County, Florida, and recorded as other liens are recorded. The same, upon recording, shall be constructive notice of the existence of said lien which may be foreclosed by the City of Clearwater in the manner in which mortgages are foreclosed pursuant to general law in the Circuit Court of Pinellas County, Florida. Section 23B- 12. Interest on Liens. The principal amount of all assessment liens levied and . assessed pursuant to this ordinance shall bear interest at the going rate existing at the time in the market place or fraction thereof from the date the lien is filed and said interest as herein provided shall also constitute a lien against the property assessed. Section 23B-13. Grace Period Prior to Establishment of Liens. Prior to assessment of liens by the Commission in accordance with Section 23B-11' herein, the City Commission shall provide each property owner with a written notice by regular mail of the cost to clear said property, together with the administrative costs, if applicable, which total would be assessed against the property, together with an invoice for payment thereof. The notice shall require payment within thirty (30) days of date of notice and shall state that it shall constitute a lien against such property if not received within thirty (30) days. No lien shall be assessed by the City Commission against any property prior to the expiration of the grace period set forth by this section. Section 23B-14. Satisfaction of Lien. . Upon payment to the City of the total amount of said lien established pursuant to this ordinance, plus interest accrued thereon, plus the recording fee necessary to record the satisfaction of said lien, a satisfaction of such lien shall be prepared and signed by the City Manager, the Mayor- Commissioner, the City Clerk and the City Attorney of the City of Clearwater which satisfaction of lien shall then be filed in the Public Records of Pinellas County, Florida. Said satisfaction of lien shall, be filed in accordance with the requirements of general law pertaining to cancellation of liens against . Section 23B-15. Fees. Fees to be assessed by the City Commission against property found to be in violation of this ordinance shall be as follows; (1) Clearance costs shall be the actual costs to the City to clear the property, either by the City or its duly authorized agent. (Z) Administrative costs shall be a fee in the amount of Seventy- five Dollars ($75. 00) to defray the cost to the City of all field investigations, inspections, reports, . administrative expenses, reinspections, notices, invoicing, and recording costs, subject to the provisions of Section 23B-9 herein. Section 2. Should any section, paragraph, sentence, phrase, clause or other part or provision of this ordinance be-declared by any court to be invalid, the same shall not affect the validity of the. ordinance as a whole, or any part thereof, other than the part declared to be invalid. Section 3.
