1887 ORDINANCE NO. 1887 01?? AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 21-5, UTILITY TAX--AMOUNT, OF CHAPTER 21, TAXATION, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT THE TAX LEVIED SHALL BE COLLECTED BY THE SELLER FROM THE PURCHASER AT THE TIME OF PAYMENT FOR SUCH SERVICE; TO PROVIDE THAT THE TAX TO BE LEVIED ON PURCHASES OF FUEL OIL SHALL BE AT THE RATE OF FOUR CENTS PER GALLON; TO PROVIDE THAT THE TAX SHALL NOT APPLY TO THE FIRST FIFTY KILOWATT HOURS OF ELECTRICITY PURCHASED EACH MONTH BY ANY RESIDENCE FOR RESIDENTIAL USE; PROVIDING A PENALTY FOR FAILURE TO COMPLY HEREWITH; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section L. That Section Z1-5, Utility Tax--Amount, of Chapter 21, Taxation, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 21-5. Wility-tax-Public Service Tax--Amount. Section Z. Any person, organization, society, association or corporation/ r: or any agent or representative thereof, who shall violate the provisions of this so-;t~; Ordinance shall be subject, upon conviction, to a fine not exceeding the sum of Five Hundred Dollars ($500.00), or imprisonment in jail for not exceeding µs ?? sixty (60) days, or by both such fine and imprisonment in the discretion of the Fudge. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section lb&. 041, Florida Statutes. Section b. This Ordinance shall become effective immediately upon its passage.
