F ORDINANCE NO. 1877 I pl+t AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER, FLORIDA, 1978, AS AMENDED, BY RECLASSIFYING AND ZONING CERTAIN PROPERTY AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR TI4E EFFECTIVE DATE OF THIS ORDINANCE. R WHEREAS, on November 2, 1978, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the zoning atlas of the City of Clearwater in accordance with procedure as established; and WHEREAS, the public hearing on certain of the proposed changes to the Zoning Atlas were continued until November 16, 1978; and WHEREAS, certain of the proposed changes and amendments to the zoning atlas were approved by the City Commission after its evaluation of all evidence presented at the said continued public hearing; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA; Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 19781T, as amended. is amended to indicate that fact as hereinafter set out: Toned as RPD - Residential Planned Development With a Maximum Allowable_ Density of 12, Units Per Acre Cormnence at the SW corner of the NW 1/4 of the SE 1/4 of Section 7, Township 29 South, Range 16 East, Pinellas County, Florida; thence S 89.4714511 E, along the South boundary of the NW 1/4 of the SE 1/4 of said Section 7, 140.00 feet for a P. O. B.; thence N 00°52'56" E, parallel to the North and South centerline of said Section 7, 210. 00 feet; thence S 89°47'45" E, 125. 00 feet; thence S 00.4215611 W, 210.00 feet; thence N 89.4714511 W, along the South boundary of the NW 1 /4 of the SW 1 /4 of said Section 7, 125.00 feet to the P. 0. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Sect 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Any person, or persons, firm or corporation or association M of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the aum of Five Hundred Dollars ($500.00), or imprisonment in Jail for not exceeding sixty (60) days or by both such fine and imprisonment in the discretion of the Judge. Each day that a violation is permitted to exist shall constitute a separate offense.. Section S. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendments as hereinabove set out. Section 7. The provisions of this ordinance shall take effect immediately upon its passage.
