ORDINANCE NO. 1870
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1978, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING PENALTIES FOR THE VIOLATION
OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on November 16, 1978, the City Commission of the City
of Clearwater, after proper public notice, held a public'hearing for the
determination and establishment of zoning classifications for certain property
annexed into the City of Clearwater in accordance with procedure as
established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were approved by
the City Commission after its evaluation of all evidence presented at the
said public hearing;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION -OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following deBcrbedlproperty in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning
Atlas of the City of Clearwater, Florida of 19781?, as amended, is amended
to indicate that fact as hereinafter set out:
Zoned as RS-75 - Single Familv Residential District
A tract of land lying in the SW 1/4 of Section 17, Township
28 South, Range'16 East, Pinellas County, Florida, being
the E 112 of the NW 1/4 of the SW 1/4, and the W 1/4 of the
NE 1/4 of the SW 1/4, less the East 10 feet thereof, and the
W 1/2 of the NW 1/4 of the SE 1/4 of the SW 1/4, and the
E 1 /Z of the SW 1 /4 of the SW 1/4, and the South 15 feet of
the S 1/2 of the SW 1/4 of the SW 1/4, less County Road
right-of-way and more particularly described as follows;
Begin at the SW corner of said Section 17; thence N 0°231
0011 W, along th'e',West line of said Section 17, for 15.00 feet;
thence S 89°54154'1 E for 667. 56 feet; thence N 0025117" W'
for 2654. 73 feet; thence S'89 '148132 11 E for 520.44 feet to a
point on the southerly right-of-way line of State RcQ d 586
(Curlew Road); thence southeasterly along said right-of-way
line and the arc of a' curve that is concave to the Northeast having
a radius of 1969.86 feet and a central angle of 13°47'0511 For
473.93 feet; thence S 0°2814411 E for 1274.01 feet; thence
S 89°5114311 E for 10.06 feet; thence S 0°2814411 E for 666.98
feet; thence N 89°53'1911 W for 333.56 feet;thence S 0.2713511
E for 667, 13 feet; thence N 89*54154t1 W, along the South line
of said Section 17, for 1335. 14 feet, to the P. O. B.

Section 2. All ordinances or arts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed
Section 3. Should any part or provision of this ordinance be declared ' F ?' .a,; .; S.r,"`' • _`
by a court of competent jurisdiction to be Invalid, the same shall not affect

.the validity of the ordinance as a whole, or any part thereof other than the ; :; •'-:
part declared to be invalid.
Section 4. Any person, or persons, firm or corporation or

association of persons, who shall violate or fail to comply with any of the .

terms or provisions of this ordinance shall, upon conviction, be fined not
exceeding the sum of Five Hundred Dollars ($500.00), or imprisoned in Jail
for not exceeding sixty (60) days or by both such fine and imprisonment in
the discretion of the Judge. Each day that a violation is permitted to exist '

shall constitute a separate offense.
Section S. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166.041, Florida Statutes.
Section b. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendments as hereinabove set out. ;
Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
