1861"••?"''}?i,?,'^?"?Yt??t;""^"?'?,?:??3``'u,?r`gr`;S'+•*,.='.`y'.:Y sI'!o-tj,?'{,• ? x CID AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 2-24, SUPPLEMENTARY POLICE PENSIONS AND RETIREMENT— NORMAL, EARLY AND DISABILITY RETIREMENT; EFFECT OF RE-EMPLOYMENT BY CITY, OF CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO ALLOW A POLICE OFFICER TO RETIRE AND RECEIVE RETIREMENT BENEFITS AT ANY AGE AFTER TWENTY YEARS OF CREDITED SERVICE; TO ALLOW A RETIRING POLICE OFFICER A LUMP SUM SETTLEMENT OPTION TO RECEIVE AN AMOUNT EQUAL TO THE COST REQUIRED BY THE TRUSTEES TO PURCHASE AN ANNUITY FOR SUCH OFFICER; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENAC'T'MENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the present lurnp suns retirement option available to members of the Clearwater Supplemental Police Pension Fund only allows 'the officer to receive a lump sure equal to the present value of a life insurance policy purchased by the Trustees of the Fund in the officer's name; and WHEREAS, the Trustees and members of the Fund wish to have the Plan amended to permit a retiring policeman to receive an amount equal to the sum required by the Trustees to purchase an annuity had the policeman chosen an annuity; and WHEREAS, the cost required by the Trustees to purchase a retirement annuity for a police officer is the total of (a) the present cash value of those pension trust life insurance policies held by the Trustees in the officer's name and (b) that amount of other trust assets equal to the difference between the annuity's cost and the present cash value of said life insurance policies on the officer; and WHEREAS, the Trustees and members of the Fund wish to have the Plan further amended to allow members to receive the benefits at any age after twenty years of service; and WHEREAS, such proposed amendments have been reviewed by the State. "?;. - nr' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 2-24, Supplementary Police Pensions and Retire- ment--Normal, Early and Disability Retirement; Effect of Re-employment by City, of Chapter 2, Administration, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by amending sub- section (B) (1) and sub-section (E), each to read as follows: (B) Early retirement. F Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any part or provision of this ordinance be declared r by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance: as a whole, or any part thereof other than the part declared to be invalid. Section 4.
