AN ORDINANCE OF THE CITY OF CLEARWATER,
VACATING A CERTAIN UTILITY EASEMENT IN
UNIT 5, ISLAND ESTATES OF CLEARWATER,
PINELLAS COUNTY, FLORIDA; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF
THIS ORDINANCE.

WHEREAS, it has been requested by J. S. Services of Florida, Inc.,
owner of certain real property in Unit 5, Island Estates of Clearwater, in
the City of Clearwater, Florida, that the City of Clearwater, Florida, vacate
a portion of a certain utility casement retained by the City of Clearwater in
Resolution No. 74»105, passed by the City Commission on September 16,
1974, and recorded in O. R. Book 3216, page 1405, of the Public Records
of Pinellas County, Florida; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said utility easement is not necessary nor
required for municipal use and it is deemed to be to the best interest and
advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section'l, That the following:
That dertAin utility easement over the
Easterly 40 feet of the Northeasterly 90 feet of
-Dory Passage as shown on the plat of Unit 5, Island
Estates of Clearwater, as recorded in Plat Book 51,
page 34, of the Public Records of Pinellas County,
.:Florida, and as set out in Resolution No. 74-105,
passed -by the City Commission of the City of Clearwater,

Florida, on September 16, 1974, and recorded in O. R.
Book 3216, page 1405, of the Public Records of
Pinellas County, Florida,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
