ORDINANCE NO. 1835
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 14, OFFENSES AND MISCELLANEOUS
PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY
OF CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT IT
SHALL BE UNLAWFUL TO THROW, DISCARD, PLACE OR
DEPOSIT LITTER IN ANY MANNER OR AMOUNT ON
DESIGNATED PLACES WITHIN THE CITY OF CLEARWATER;
PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF SUCH CONFLICT; PROVIDING PENALTIES FOR THE
VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Chapter 14, Offenses and Miscellaneous Provisions, of
the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby
amended to enact a new Section 14-72 to read as follows:
Section 14-72. Littering, public or private property.
It shall be unlawful within the boundaries of the City of
Clearwater, Florida, for any person to throw, discard,
place or deposit litter in any manner or amount:
(a) In or on any public road, street, alley or thorough-
fare, including any portion of the right-of-way thereof,
within the City of Clearwater, Florida, over which it
has jurisdiction pursuant to Section 316.006 (2), Florida
Statutes, or any other public lands, except in containers
or areas lawfully provided therefor; provided that in
any case where any litter is thrown or discarded from
a motor vehicle the operator of the motor vehicle shall
be deemed in violation of this section.
(b) In or on any freshwater lake, pond, or stream or tidal
or coastal water,
(c) In or on any private property, unless prior consent of
the owner has been given and unless such litter will not
cause a public nuisance or be in violation of any other
local- ordinance or state statute.
Within this section, the term "litter's shall mean any garbage,
rubbish, cans, bottles, trash, refuse, containers and papers.

Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.

Section 3. Any person, organization, society, association or
corporation, or any agent or representative thereof, who shall violate the
provisions of this ordinance shall be subject, upon conviction, to a fine not
exceeding the sum of Five Hundred Dollars ($S00. 00), or imprisonment for
not exceeding sixty (60) days, or by both such fine and imprisonment in the
discretion of the ,judge.
Section 4. Should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section S. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
Section 6. This ordinance shall become effective immediately upon
its passage.
