AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ENACTING SECTION Z4-14, 24-15, Z4-16 and 24-17 OF
ARTICLE II, OF CHAPTER 24, PERTAINING TO GAS
SERVICE, OF THE CODE OF ORDINANCES OF THE.CITY
OF CLEARWATER, FLORIDA, 19620 TO ENACT A NEW
SCHEDULE OF RATES; PROVIDING FOR THE SEPARABIL-
ITY OF THE PROVISIONS HEREOF; PROVIDING FOR
REPEAL OF ALL ORDINANCES OR PARTS'OF ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE
OF PROPOSED ENACTMENT AND PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City of Clearwater, Florida, functions as a
municipal utility supplying gas service to the City and its inhabitants; and
WHEREAS, it is necessary to fix the rates to be charged for such
gas service; and
WHEREAS,. the City Commission, after the proper public notice
held a public hearing on September 7, 1978, upon the recommendation
of the City of Clearwater Utilities Department to revise the rates for the
sale of natural gas; and
WHEREAS, the City Commission deems it necessary to establish
such new gas rates effective as of October 1, 1978;
NOW, THEREFORE BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Sections 24-14, 24-15, 24.-16 and 24-17, of Article II,
Gas, of Chapter 24, Utilities System, of the Code of Ordinances of the
City of Clearwater, 1962, are.hereby enacted to read as follows:
Section 24-14. General Gas Service Rates. (Schedule A)
The following general rate schedule shall ap2lX to all users
of natural gas provided by the City of Clearwater, Fl•:orida,
provided such users are located adjacent to the City of
Clearwater gas mains and Provided the City of Clearwater
has a sufficient supply_of natural gas to furnish.

Section 24-15. Air Conditioning Gas Rates. Schedule B
The following rate schedule shall apply on a year-round basis to
all buildings or remises using as for air conditionin ur oses,
either through usin combination cooling-heating equipment or
through using cooling equipment only, but shall not apply to
remises not having air conditioning a ui ment located thereon,
and shall be subject to the provisions further set forth herein;
(a) Residential.
Where all as used on the remises is measured
through a single meter, the rate for gas containing
not less than 1, 000 BTU per cubic foot shall be:
First 10 therms or less $7.15
Next 40 therms .23928
All over 50 therms . 20368
b Commercial.
The following rate shall apply for air-.conditioning,
providing said service is separately metered and
that said service is adjacent to the Ci mains and
where the City has sufficient sup„•ply of gas:

Schedule D, - -

and provided the City of Clearwater has sufficient supply of natural gas:
Natural gas containing not less than 1, 000 BTU per 100 cu. ft.:

Section 24-17. Purchased Gas Coat Adjustment.
The charges specified in the above schedules shall be
subject to_an adjustment per therm for increases or
decreases in the supplier's rate for purchased gas in
accordance with the rovisions of the purchased gas?
cost adjustment in Florida Gas Transmission_Company!s-
tariff.
Section 2. That Section Z of Ordinance Number 828 passed by the
City Commission of the City of Clearwater on July Z0, 1959 be and the same
is hereby repealed.
Section 3. Should any section, paragraph, sentence, phrase, clause
or other part or provision of this ordinance be declared by any court to be
invalid, the same shall not affect the validity of the ordinance as a whole, or
any part thereof, other than the part declared to be invalid.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a:anewspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 5. This ordinance shall become effective October 1, 1978.
