AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE SOUTH 15 FEET OF A RIGHT-OF-WAY KNOWN AS
DRIGGERS ROAD/COUNTY ROAD NO. 97E, LYING IN SECTION 17,
TOWNSHIP 28.. SOUTH, RANGE 16 EAST, PINELLAS COUNTY,
FLORIDA, SUBJECT TO A UTILITY EASEMENT WHICH IS RETAINED
OVER THE FULL WIDTH THEREOF; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, it has been requested by Velventos, Inc., owner of certain real
property located in the City of Clearwater, that the City vacate the right-of-way
described herein; and
WHEREAS, the City Commission finds that said right-of-way is not necessary
for municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE 'IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The South 15 feet of the West 1/2 of the West 1/2 of the Southwest
1/4 of Section 17, Township 28 South, Range 16 East, also known as
Driggers Road/County Road No. 97E, Pinellas County, Florida,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto, except that the City of
Clearwaterhereby retains a utility easement over the described property for the
installation and maintenance of any and all public utilities thereon.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
