ORDINANCE NO, 5077-91
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING THE WESTERLY 8 FEET OF A 25-FOOT DRAINAGE AND
UTILITY EASEMENT, LYING ALONG THE EASTERLY LINE OF LOT
1, BLOCK J, BROOKHILL UNIT 11, PINELLAS COUNTY, FLORIDA;
PROVIDING AN EFFECTIVE.DATE.
WHEREAS, it has been requested by Herman and Sharron Bailey, owners of
certain real property located in the City of Clearwater, that the City vacate the
drainage and utility easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The Westerly 8 feet of the 25-foot drainage and utility easement,
lying along the Easterly line of Lot 1, Block J, Brookhill Unit II,
as recorded in Plat Book 41, Page 43, of the public records of
Pinellas County, Florida,
is hereby vacated, closed and released, and the City of Clearwater quitclaims and
releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
