BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 53, Code of Ordinances, consisting of Sections 53.01 through 53.45, is amended, and Sections 53.015 and 53.11 are added to said chapter, to read: CHAPTER 53. WASTEWATER COLLECTION SYSTEM ARTICLE I. GENERALLY Sec. 53.01. Entire system a unified public utility. The present wastewater collection system of the city, together with any and all extensions thereof and replacements thereto, and the wastewater treatment plants now operated by the city and any and all such plant hereafter acquired and operated by the city, -be d?thesame are hereby established and declared to be a public utility for the use and benefit of the city in the maintenance of public health, welfare and sanitation throughout. the city. The system shall be controlled, operated and maintained as provided in section 50.01. See section 50.05 for deposit, fees and rate schedules. Sec. 53.015. Definitions. As used in this cha ter: La)_ "Abnormal stren th waste" means waste having a high-degree of concentration of permissible waste material per unit volume of wastewater discharged b the customer. (a) Any person who desires to connect his property, place of business or residence with the wastewater collection system of the city shall comply with the provisions of this chapter and shall pay the connection charges. See section 50.05 for fees. Inflammables, explosives prohibited. No person shall discharge into any public or private wastewater collection system or appurtenance thereof, whereby there may be eesyeyed into the , any suffocating, corrosive, inflammable or explosive liquid gas, vapor, substance or material. Sec. 53.06. Obstruction of flow prohibited. No person other than an agent of the city shall do any act or thing which may impair or obstruct the flow of any public wastewater system or clog up any t? appurtenance thereof, or place therein any substance, solid or liquid, other than r` the waste products for which sewers are provided. Sec. 53.07. Privies. It shall be unlawful for any person to construct or maintain any privy of any type where water under pressure is available on or adjacent to his property. N Where such water is not available, the construction and maintenance of all privies shall comply with the rules and regulations of the county health officer. Sec. 53.08. Schedule of service rates. (a) There is an established uniform schedule of rates and charges for the i use or. availability for use of this utility. See section 50.05 for fees. A custom_ ocated_at premises °' r. which have a source of water other than the city water system, and _which _discharge -the spent P-P used- w-atelp from whi eh des into the city wastewater collection p system, shall pay a charge according to the schedule providea in section 50.05 for fees based upon an estimate of the amount of water going into the wastewater collection sanitary sewev system. In the event of a disagreement as to the amount of such water reaching the saRkary sewer system, 4hen; a city-approved metering device or devices shall be installed at the customer's expense to determine that amount. Sec. 53.10. No free service. No wastewater collection sewerservice shall be furnished or rendered free of charge to any person whomseeYe . The city, county and state and every agency, department or instrumentality thereof,- which is connected to the wastewater collection system shall pay therefor at the rates and charoes fixed in section 50.05 herein• or as established by agreement. An adjustment to sewer service charges will be available for charoes due to the-operation of a separately metered cooling tower, or due to an unusual circumstance resulting in the consumption of water which does not enter the wastewater treatment-system, such as an undetected domestic water leak or the filling of a_swimming pool or spa,_ as approved bv_the_utility customer support manager. Such adjustments shall not be available for lawn irri ation or other usual and customer uses of water. An such adjustment shall be requested-and substantiated b the customer within 90 days following the date of repair or unusual circumstance and shall he fora eriod not exceeding 90 days preceding the date of re air or unusual circumstance. (a) Within, without city. Except as specifically provided in this article, all buildings t4al in ..h.,'^a4te2 designed or used for human habitation= ar occupancy ep- use located within the city shall be connected to the wastewater collection system by the city. Such buildings located-outside the city and served by the city water system and to which the city wastewater collection system is reasonably available may connect to said system upon application to and approval by the city manager and on payment of connection fees and-monthly service charges as established by the city commission for such outside property. Fiowever,•such buildings located outside the city _shall be connected- to the-wastewater- collection system_ only upon annexation of the property into the city or, if the property cannot lawfull be annexed, upon execution by the property owner and the city of an aareement_to. annex the property when annexation may lawfully occur. Each such agreement shall constitute?a covenant ^running ?with the land and shall be subject to recordation in the public records of Pinellas County. (b) Certificate of occupancy. No certificate of occupancy shall be issued for any s44h building within the city unless a wastewater collection system saMtary er connection has been made thereto, unless the building division shall find that the wastewater collection system a sanitary sewer is not reasonably available and that sueh a?;a4n will not be available by the time that the -&t" building is ready for use, c" r`.tpeeter sush build4ng 4s leeated aRd does not abut an a sew., maln - that a eennerat4eft to the ma4n is not feasible rthe--9pinion of the city engineer. Sec. 53.21. Time for making connections. All buildings ep designed or used for human habitation or occupancy that are hereafter erected in the city in locations where the wastewater collections stem is mains e not reasonabl?r available for connection at the time such buildings are t completed or occupied, may be permitted to temporarily use septic tanks or such i, other method of wastewater disposal as may be approved by the applicable health authorities; however, such buildings shall be connected to the wastewater collection san-i-t"aFy-sewer system of the city within ninety (90) days after notice has been -given to the owner that the system is bee$mes available for connection. Sec. 53.23. Wastewater treatment facilities Septa authorized in certain instances. Where the city cannot provide adequate wastewater collection saflPtaiay se facilities for 4* any parcel of land within the city limits,, upon which there is located or to be located a dwelling house or building in which wastewater collection system 5an4tary facilities are needed or required, the owner thereof or a licensed master plumber, upon written application to the building division 'spe er, may obtain a permit to build a wastewater treatment facility sept4e , providing that construction thereof is to be in conformity with all existing requirements of the city and state laws, rules and regulations. No permit hereunder shall be issued more than two (2) weeks prior to the date construction of the building shall begin. Sec. 53.24. Regulations governing wastewater collection system sewer connection; inspection; approval. All connections to the wastewater collection system sanitary eweFs of the city shall be done in accordance with the provisions of the plumbing code of the city and in accordance with city, state and county rules, regulations and laws. Samples shall be a composite over not more than a three (3) day period of operation of the actual quality of the wastes. Samples for analysis shall be collected by a city employee. Analysis shall be made by a graduate chemist, laboratory technician, or a class A or B wastewater treatment plant operator, qualified in accordance with standards established by the department of environmental regulations, and registered in this state, using the laboratory methods for the examination of industrial waste as set forth by the department of environmental regulation and the environmental protection agency. Sec. 53.37. Extension of time. When, due to the size or complexity of the waste disposal problem of an industry, it can be shown that it is impractical to meet the schedule imposed hereunder, a request for an extension of time may be presented to the water pollution control division utilities d4reetor. Sec. 53.38. Control manhole. Any person discharging industrial wastes into the wastewater collection 4 system shall cause to, be constructed and maintained at his expense a suitable control manhole or manholes downstream from any treatment, storage or other approved works, to facilitate observation, measurement and sampling of all wastes, including domestic wastewater from the premises. The control manhole or manholes shall be constructed and located and built in a manner approved by the cites engineer and shall include a flow measuring device. j The control manhole shall be accessible to the city at all times for sampling. Sec, 53.39. When pretreatment required. The user of the wastewater collection system shall provide at his expense such preliminary treatment or handling as may be necessary to modify the characteristics, or concentration of wastes to satisfy the limit set forth in this chapter: Sec. 53.140. Right-of-entry. Agents of the city employees of the utility departm bearing proper credentials and identification shall be permitted to enter upon all properties for the purpose of inspection, observation, measurement, sampling and testing in accordance with the provisions of this chapter.
