Chapter 52, Code of Ordinances, consisting of Sections 52.01 through 52.50, is amended to read: 11 CHAPTER 52. WATER SYSTEM ARTICLE I. IN GENERAL Sec. 52.01. A unified system. The present water system of the city, together with any and all extensions thereof and replacements thereto or facilities hereafter acquired by the city, shall be controlled, operated and maintained as provided in section 50.01. See section 50.05 for deposit, fees, service charges and rate schedules. Sec. 52.015. Definitions. As used in this chapter: "Auxiliary water supply" leans[; r h " ' rcrri-MAAA a water supply from any source other than the public potable water system. "Consumer's water system" means a water system connected to the city potable water supply, from the point of delivery to the extremities of the system. "Cross-connection" means any connector or structural arrangement between two (2) otherwise separate piping systems, one of which contains City potable water and the other water or fluid from another source. "Double-check valve assembly" means an assembly composed of two (2) single, independently acting, approved check valves, including tightly closing shutoff valves located at each end of the assembly and suitable connections for testing the watertightness of each check valve, "Health department" means the Pinellas County Public Health Unit of the Florida Department of Health and Rehabilitative Services. "Nonpotable water" means sha4l mean water which is not safe for human consumption, or which is of questionable quality. "Plumbing official" means shall nom the building official of the city. "Point of delivery" (or "service connection") means the terminal end of a service from the public potable water system at the downstream end of the water meter or at the downstream end of a backf low prevention device if installed; that is, where the water division loses jurisdiction and sanitary control over the water. "Potable water" means water that is safe for drinking, personal or culinary use. "Public works department" means s'"'zxnr the public works department of the city or its officers, employees or agents. "Reduced-pressure-principle backflow prevention device" means a device containing'a minimum of two (2) independently acting, approved check valves, with an automatically operated pressure differential relief valve located between the two (2) check valves. The unit shall include tightly closing shutoff valves located at each end of the device, and each device shall be fitted with properly located test cocks. During normal flow and at the cessation of normal flow, the pressure between these two (2) checks shall be less than the upstream (supply) pressure. Tapping of all existing mains, installation of service lines from the mains to the meter, and meter installation shall be done by the water division. (b) Furnishing equipment, cost, deposit, rate schedule and tap fees. Sec. 52.04. Meters--City to regulate; cost of maintenance; responsibility for damage. The installation or reinstallation of a service line to an remise shall require a separate water meter for each service line. The water division department alone shall have the right to approve -stipulate the size, type, make, and location and the typ& of meters meteF setting. The customer shall w444 be held responsible for damage as a result of hot water, or other external causes when such damage results from the negligence of the customer. When such damage occurs, the city will furnish and set another meter and repair the one damaged and the cost of such repairs, including replacement parts, labor and transportation charges, shall be paid for by the customer. Sec. 52.07. Same--Testing. The water division 4epakaefvt reserves the right to remove or test any VIA meter at any time and to substitute another meter in its place. (1) To provide for the protection of the public potable water supply; (2) To isolate at the service connection any actual or potential pollution or contamination within the consumers' premises; and (3) To provide a continuous, systematic and effective program of cross- connection control. Sec. 52.32. Reserved. Sec. 52.33. Responsibilities. (a) The plumbing official shall enforce the provisions of the Standard Plumbing Code so as to ensure the potability of water in the consumer's water system, downstream from the point of delivery. The plumbing official shall have primary enforcement responsibility over new installations, alterations or repairs of consumer's water systems. (b) The water division shall have primary responsibility mar-y' ° f spans; bl for the prevention of contamination and pollution of the public water system. Such responsibility begins at the point of origin of the public water supply and includes adequate treatment facilities and water mains, and ends at the point of delivery. (c) The consumer shall have primary responsibility for preventing contaminants and pollutants from entering the consumer's water system; and from entering the public water system from the consumer's water system. The consumer shall protect the consumer's water system against actual or potential cross- connection, backf low or back-siphonage, as required by this article, the Standard Plumbing Code and other applicable regulations, and shall assure that all internal protective devices are tested and maintained in the working condition required. The consumer shall assure that the necessary plumbing permits are obtained for new water system installations, and for alterations or repair to existing systems. Sec. 52.34. Operational criteria. It is the primary responsibility of the water division to evaluate the hazards inherent in supplying a consumer's water system, new or existing, and to determine whether solid, liquid or gaseous pollutants or contaminants are, or may be, handled on the consumer's premises in such a manner as to permit contamination of the public water system. The costs of installation of each device shall be borne by the consumer according to the schedule of fees set forth in Section 50.05. -; Sec. 52,35, Backflow prevention devices. The type of backflow prevention device required shall depend upon the degree of hazard as described in AWWA Manual M-14 (1966 edition), which is adopted by reference as if set forth herein, or as described below. Where more ` than one type of device is available, the actual type utilized shall be as z ' determined by the water division subsequent to physical inspection of the hazard. (1) In the case of any premises where there is an auxiliary water supply, : ? there shall be no physical connection between the auxiIiarY water supply and the consumer's water system. Where such connections are found, the auxiliary system r shall be immediately disconnected and the public water system shall be protected z" against the possibility of future reconnection by the installation of an approved ' reduced-pressure-principle backf low prevention device at the service connection. (2) In the case of any premises where there is water or a substance that would be objectionable but not hazardous to health, if introduced into the public water system, the public water system shall be protected by an approved double- check valve assembly. (3) In the case of any premises where there is any material dangerous to health which is handled in such a fashion as to create an actual or potential Ti.a• hazard to the public water system, the public water system shall be protected by an approved reduced-pressure-principle backflow prevention device. Sec. 52.37. Approval of backflow-prevention devices, Any backflow prevention device required herein shall be of a type in accordance with AWWA specification C506-78 (1983 Revision), which is adopted by ,reference as if set forth herein. Sec. 52.38. Noncompliance; service to be discontinued; notice; consent to entry. (a) In emergency situations when the public potable water supply is being contaminated or is in immediate danger of contamination, water service will be discontinued by the water division until the situation is corrected. (b) No water service connection shall be installed on the premises of any consumer unless the public potable water system is protected as required by this article. (c) Delivery of water to the premises of any consumer maybe discontinued by the water division if any protective device required by this article has not been installed, or is defective, or has been removed or bypassed. Water service shall not be resumed until conditions at the consumer's premises have been abated or corrected to the satisfaction of the water division. (d) Upon discovery of a violation of this Code, written notice shall be given to the consumer. If violations are not corrected by the date and time as situated on the notice, water supply shall be discontinued and the violation shall be referred to the code enforcement board for further action. (e) For the purpose of making any inspections, testing, maintenance or discharging the duties imposed by this article, the water division, the health department, and the plumbing official, shall have the right to enter upon the premises of any consumer. Each consumers as a condition of the continued delivery to the premises of water from the public water supply, shall be considered as having consented to the entry upon the premises by the water division, the health department, and the plumbing official for the purpose stated herein. Sec, 52.41. Reserved. Sec, 52.42. Areas embraced. All territories within Pinellas County served by the Clearwater Water Division shall be embraced by the provisions of this article. ARTICLE M. WATER SHORTAGE PLAN Sec. 52.43. Definitions. For the purpose of this article the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the contest, words used in the present tense include the future, words in the plural include the singular, and words in the singular include the plural. The word "shall" is always mandatory and not merely directory. District is the Southwest Florida Water Management District. Person is any person, firm, partnership, association, corporation, company :i a or organization of any kind. Water resource means any and all water on or beneath the surface of the ground, including natural or artificial watercourses, lakes, ponds, or diffused surface water, and water percolating, standing, or flowing beneath the surface of the ground. Water shortage condition is when sufficient water is not available to meet present or anticipated needs of persons using the water resource, or when conditions are such as to require temporary reduction in total water usage within a particular area to protect the water resource from serious harm. A water shortage usually occurs due to drought. l Sec. 52.44, Application of article. The provisions of this article shall apply to all persons using the water resource, whether from public or privately owned water utility systems, private s wells, or private connections with surface water bodies. Declaration of water shortage, water shortage emergency. (a) The declaration of a water shortage or water shortage emergency within all or any part of city water service area by the governing board or the =.`a executive director of the district shall invoke the provisions of this article. i' (b) Upon such declaration all water use restrictions or other measures pi adopted by the district pursuant to Chapter 40D-21, Florida Administrative Code, T? R t"M1 4 applicable to city or any portion thereof, shall be subject to the enforcement action pursuant to section 52.46 of this article. Any violation of the ?iprovisions of Chapter 400-21, Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this article. Sec. 52.46. Enforcement. Every police officer or sheriff of the county or cities in the service areas governed by this article shall, in connection with all other duties imposed by law, diligently enforce the provisions of this article. In addition, the city manager may also delegate the authority o 4ep designated employees .. t'?4- the ut!144es department of the city to issue written warnings to persons in violation of this article. Sec. 52.47. Penalties. Violation of any 'provision of this article shall be subject to the following penalties: First violation: Twenty-five dollars ($25.00). Second and subsequent violations: Fine not to exceed five hundred dollars ($500.00) and/or imprisonment in the county jail not to exceed sixty (60) days. Each day in violation of this article shall constitute a separate offense. In the initial stages of a water shortage or water shortage emergency, law enforcement officials may, in their discretion, provide violators with one, but not more than ;t one, written warning. Sec. 52.48. Wafter users to accept provisions of this article. No water service shall be furnished to any person by a public or private utility unless such person agrees to accept all the provisions of this article. The acceptance of water service shall be in itself the acceptance of the provisions thereof. Sec. 52.49. Public hearings and notices required. Sec. 52.50. Recision. When the governing board and executive director of the district determines that a water shortage condition no longer exists, or no longer exists to the same degree, the district shall rescind or modify the restriction it has adopted. Notification to local governments and to other persons affected by this article shall be according to the provisions of section 52.49 hereof. Section 2. Sections 52.10 and 52.11, Code of Ordinances, are hereby repealed. Section 3. This ordinance shall take effect immediately upon adoption.
