BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 50, Code of Ordinances, consisting of Sections 50.01 through 50.17, as amended by Ordinances 4957-90, 4993-90, 4994-90, 5015-90, and 505890, is further amended to read: CHAPTER 50. IN GENERAL Sec. 50.01. Utilities combined in one system. All municipal utility properties real and personal of the city supplying gas, water, wastewater, solid waste service and stormwater management in and to the city and its citizens and inhabitants and users thereof, shall be accounted for in accordance with generally accepted accounting principles, and shall be controlled, operated, and maintained on a combined and consolidated basis as a single utility system. Separate accounting records shall be maintained for each of the foregoing services in order to determine revenues and operating expenses for each service. Sec. 50.02. Definitions. An appeal to the city manager shall be commenced by the customer's filing a written request with the utility customer support manager within five (5) days of the date the notice was rendered. No agreement for payment of delinquent charges shall operate to forgive or discharge such delinquency until the charges are paid in full, and a breach of such agreement shall give the city the right to terminate service immediately and without further notice to the customer. (c) Complaints relating to bills shall be made before the past due date shown on the bill. Where the customer has not been billed for services rendered, the city shall have the right to back-bill for any such services. (d) Any bill in an amount greater than three dollars 3.00 which is not paid within twenty-cne (21) days of the date the bill was rendered shall be subject to a monthly penalty of two (2) per cent of the unpaid balance or three dollars ($3.00), whichever is larger. However, such penalty shall not exceed two hundred fifty dollars ($250.00) per month. Sec. 50.065. Proration of Char es. Utility system charges for less than a complete billing cycle ma be rorated as follows: a Non-metered service. The prorated charge shall be the monthly fixed fee divided b the number of days-in the billing cycle, multi lied b the number of days of service availability. b Metered service. For metered service- (1) If the consumption was zero the monthly minimum fee shall be divided b the number of days in the billing cycle, multiplied-by the number of days of service availability. 1) If there was consumption, but less than the monthly minimum consumption, the charge shall be either the charge for actual consumption or a prorated fee determined as in paragraph 1 above whichever is greater. 3 If there was consumption equal to or greater than the monthly minfinum consumption, the charge shall not be prorated. Such lien shall become effective immediately upon the distribution of the utilities to the premises, except to the extent prohibited by Section 180.135, Florida Statutes, as amended from time to time, relating to unpaid utility charges by former tenants. Sec. 50.08. Resolutions making lien final and notice of lien. Every six (6) months or less the city manager shall present to the city commission a list of properties with unpaid utility charges setting forth the owner's name, location of the property and amount of unpaid utility charges. The city commission after notice to each property owner named on the list shall, following any public hearing, consider the adoption of a resolution making the lien described in section 50.07 final. Upon the adoption of such a resolution, a the utility lien for the amounts contained in such resolution shall be and constitute a lien superior in dignity to all other liens and encumbrances of whatever kind and character save and except ad valorem taxes levied and assessed by the state, county or city, and shall remain a lien against each such property t. Y; until paid. Following adoption of the utility lien resolution, the city manager shall immediately cause such resolution to be filed with the city clerk. The city 'j manager may file and record, in the office of the clerk of the eounty circuit court, notice of the utility liens against each such property, showing thereon the amount of the lien and a legal description of the property. ft Sec. 50.09. Termination of service; suit for collection of charges, J?. assessments; exception. The city, by and through its officers, agents or employees, may, subject to the notice and appeal process provided in section 50.06, terminate utility w; service to any premises upon which any utility rates, assessments or charges shall be accrued, or may institute suit for collection of such utility rates, t assessments or charges in any court of competent jurisdiction, except to the extent prohibited by Section 180.135, Florida Statutes, as amended from time to time, relating to unpaid utility charges by former tenants. Sec. 50.16. Inspection of premises; discontinuance of service. As a condition of receiving or continuing to receive utilities service from the city, the duly authorized representatives of the city shall be permitted at reasonable times to make necessary inspections of utilities facilities on private premises where such inspections are reasonably necessary to insure the compliance with the ordinances of the city relating to such services. If for any reason access is denied, a written notice will be delivered or mailed to the premises and to the owner, if not owner occupied, stating a reasonable time in which such inspection is needed to be made, the reasons therefor, and the effect of failure to allow such inspection. If the city's duly authorized representative is then denied access to the premises for such inspection, the city may then discontinue all utilities services to such premises until such inspection is permitted. Sec. 50.17. Information to customers. Upon request of any customer of the utility system, it shall be the duty of the utility providing service to provide the customer a copy or explanation of the utility's rates applicable to the service furnished or to be furnished such customer. Y', Section 2. Sections 50.13 and 50.14, Code of Ordinances, are repealed. Section 3. This ordinance shall take effect immediately upon adoption; however, the provisions of Section 50.05(b)(9), relating to refunds of deposits, shall take effect July 1, 1991.
