F. _ ORDINANCE NO.-SO AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE PROCUREMENT OF RECYCLED PAPER BY THE CITY; ESTABLISHING POLICIES TO ENCOURAGE THE PROCUREMENT OF RECYCLED AND RECYCLABLE PAPER PRODUCTS BY THE CITY, PROVIDING FOR DEFINITIONS; ESTABLISHING REQUIREMENTS FOR PURCHASING CONTRACTS; PROVIDING FOR REPORTS; ESTABLISHING RESPONSIBILITIES FOR THE PURCHASING DIVISION; PROVIDING FOR EXEMPTIONS; PROVIDING FOR CONDITIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the policy of the City of Clearwater to promote the use of recycled paper products in order to stimulate the demand for such products and to divert paper products from the solid waste stream; and WHEREAS, the City Commission finds and determines that preferential procurement programs requiring the use of such products will encourage and promote the use of recycled and recyclable paper products by city departments, agencies and contractors, and will increase the overall demand for recycled and recyclable paper products; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Purpose. The purpose of this ordinance is to promote market development of recycled products and recyclable paper products by establishing preferential procurement programs applicable to all departments and agencies of the city and the contractors doing business with the city. Section 2. Definitions. As used in this ordinance: (1) "Contractor" means any person, natural or artificial, having a contract to provide services, labor or materials to the city, or who is a subcontractor under a contract to provide services, labor or materials to the city. The term includes, but is not limited to, consultants and suppliers. (2) ' "Department" shall refer to any department under the direction of the city manager of the city. (3) "End use" means an intended final use of a product by a consumer which will not result in additional value being added to the product. (E4) "Minimum content standards" means standards set by the city specifying the minimum levels of recovered material and post-consumer material necessary for designated products to qualify as recycled products. (5) "Paper and paper products" means all items manufactured from paper or paperboard. (7) "Post-consumer paper material" means: (a) Paper, paperboard and fibrous wastes including corrugated boxes, newspapers, magazines, mixed waste paper, tabulating cards and used cordage after the point at which they have passed through their end use as consumer items; and (b) All paper, paperboard and fibrous wastes that enter and are collected as mixed municipal solid waste. (8) "Recovered paper material" means paper waste generated after the completion of a paper making process, such as post-consumer material, envelope cuttings, bindery trimmings, printing waste, cutting and other converting waste, butt rolls, and mill wrappers, obsolete inventories, and rejected unused stock. The term shall not include fibrous waste generated during the manufacturing process, including but not limited to fibers recovered from waste water or trimmings of paper machine rolls (mill broke), or fibrous by-products of harvesting, extractive or woodcutting processes, or forest residue such as bark. (9) "Recyclable product" means a product which, after its intended end use, can demonstrably and economically be diverted from the city's solid waste stream for use as a raw material in the manufacture of another product. Section 3. Policies (1) Each department shall use recycled products and recyclable products to meet its needs whenever practicable, subject to market availability. (2) whenever practicable, the city shall require its contractors to use recycled products and recyclable products in fulfilling contractual obligations to the city. (3) In procuring designated products pursuant to this ordinance, the city shall require recovered material and post-consumer material content to be factors in determining the lowest responsive and responsible bid in any competitive bidding procurement process. (4) The city shall promote the use of recycled products and recyclable products by publicizing its procurement program and by disseminating information about recycled products. Section 4. Re uirements for Purchasing Contracts. Nothing contained in this ordinance shall preclude uaer departments from requiring post-consumer or recovered material content as a specification in invitations to bid for paper products. (2) In determining the lowest responsive and responsible bid for the purchase of paper products pursuant to competitive bidding, the purchasing manager shall use the procedures and evaluation criteria specified in this ordinance. If the lowest bid price for a recycled paper product is not more than ten (10) percent higher than the lowest bid price for the same paper product that is not recycled, the bid price for the recycled paper product shall be considered the low bid if such bidder is otherwise responsive and responsible. (3) Each contractor supplying the city with recycled paper products pursuant to an invitation to bid or request for proposal initiated after October 1, 1991, shall provide certifications acceptable to the city from all product manufacturers that the products being supplied meet or surpass city minimum content standards, and shall agree to reasonable verification procedures specified by the purchasing manager. Section 5. Rules and Reuulations._for -Procurement of Paper and_ Paper Products, (1) The city's recycled paper procurement goal for user departments, expressed as a percentage of the total volume of paper purchased, shall be not less than thirty percent by October 1, 1992, and not less than forty percent by October 1, 1993. Each department shall be responsible for making its best effort to meet or surpass these goals. (2) The purchasing manager shall adopt minimum content standards for recycled paper products. The minimum content standards shall be consistent with the standards adopted by the United States Environmental Protection Agency and published at 40 CFR' Part 250.21, unless it can be determined that a higher standard would significantly increase recycled product content without adversely affecting availability. (4) To reduce the volume of paper purchased, departments shall use both sides of paper sheets whenever practicable. (5) The city shall require all persons submitting responses to requests for proposals or invitations to bid to agree to the following as a precondition to contract award: (a) All reports submitted to the city by a contractor in fulfillment of contract obligations shall use recycled paper when it is available at a reasonable price and of satisfactory quality to meet contractual performance standards. For the purposes of this paragraph, the price of recycled paper shall be considered "reasonable" if its cost is no more than ten percent higher than the lowest price offered for non-recycled paper. (b) All reports submitted to the city by a contractor shall.use both sides of paper sheets whenever practicable. (c) Contractors shall be responsible for maintaining records documenting usage of recycled paper for reports submitted to the city in fulfillment of contractual obligations. Contractors shall submit such records to the city according to procedures to be established by the purchasing manager not later than October 1, 1991. Section 6. Annual Report. At the end of each fiscal year, the purchasing manager shall submit to the city manager a report evaluating the procurement program. The report shall include, among other things, a summary of program 4 promotional efforts, and recommended changes in the procurement policies. Section 7. Responsibilities of the Purchasing Division. The purchasing division is responsible for: (1) Revising or amending standard bid documents and contract language where necessary to implement this ordinance. (2) Collecting data on purchases by departments of designated products on city purchase orders; (3) Preparing bid invitations for recycled products; (4) Maintaining a directory of recycled products and local vendors; and (5) Disseminating recycled product information to departments. Section S. Exemptions.
