ORDINANCE NO.--5055-90 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE LAND DEVELOPMENT CODE; AMENDING SECTIONS { 134.015, 134.018, 137.012, AND 137.020, CODE OF ` ORDINANCES, TO PROVIDE THAT VARIANCES FROM THE SIGN REGULATIONS MAY BE GRANTED BY THE CITY COMMISSION, RATHER THAN BY THE DEVELOPMENT CODE ADJUSTMENT BOARD; CLARIFYING THE POWERS AND DUTIES OF THE DEVELOPMENT CODE ADJUSTMENT BOARD WITH RESPECT TO VARIANCES FROM THE SIGN REGULATIONS AND ALCOHOLIC BEVERAGE ESTABLISHMENT MINIMUM .' SEPARATION REQUIREMENTS; PROVIDING AN EFFECTIVE DATE; , :•:,:;:. PROVIDING FOR APPLICATION TO PENDING APPLICATIONS FOR '..;; VARIANCES FROM THE SIGN REGULATIONS. WHEREAS, the amortization period for nonconforming signs, established as seven years from October 13, 1985, will expire in approximately two years; and WHEREAS, the City Commission desires to regulate variances from the sign code regulations as provided herein to limit the number of variances granted subject to an expiration date, and the number of nonconforming signs which will a r require compliance with the sign regulations after October 13, 1992; and ; WHEREAS, the City Commission also desires to regulate variances from the sign code regulations as provided herein to limit the number of variances granted, and to limit the number of lawful but nonconforming signs generally; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Subsection (f) of Section 134.015, Code of Ordinances, is amended to read: Sec. 134.015. Nonconforming signs. (f) Any person aggrieved by the provisions of this section may apply to the city commission dey pment code adjustment for a variance in accordance with section 137.012. Any request for a variance shall be filed with the development code administrator at least ninety (90) days prior to October 13, 1992. In addition to the standards which govern variances contained in section 137.012, the city commission board shall consider the propriety of the application of this section based upon the following factors: (1) Type and extent of the nonconformity (e.g., use, size, height, number and setback). (2) Location of the nonconforming sign. (3) Potential adverse aesthetic effects on the property or building, if any. (4) Nature of the surrounding uses, both on-site and off-'site. °. The board or the cit commission may a4o impose conditions on the grant of any variance as determined necessary to carry out the intent and purpose of this development code. The city reserves the full authority to revoke a variance if any conditions so imposed are not strictly and continuously adhered to. Under no circumstances shall the development code adjustment board grant a variance to permit a use not permitted or conditionally allowed in the zoning district involved, permit any use expressly or by implication prohibited by the terms of this development code, permit an increase to the maximum density allowed in a particular zoning district, permit the expansion, addition to or enlargement of a nonconforming use, or authorize a variance to any like provision of legislative prerogative. (c) Review procedures. (1) The development code administrator shall, upon determination that the application complies with all applicable submission requirements, receive the application and instruct the city clerk to schedule it for public hearing by the development code adjustment board or, for a request for a variance from the sign reoulations or the alcoholic beverage establishment minimum separation requirements, by the_city_comm•ission, and give notice of such hearing in accord with the requirements contained in article V of this chapter. (2) The development code adjustment board or the city commission shall consider the application and render a decision at the conclusion of the public I hearing unless the board or the city commission determines that action must be deferred to allow for additional input and review. (d) Standards for approval. A variance shall not be granted by the unless the application and evidence presented clearly support the following conclusions: (e) Conditions and restrictions on approval. In granting a variance, the development code adjustment board or the city commission may impose such conditions and restrictions upon the property benefitted by the variance as may be necessary to comply with the standards set out above, to reduce or minimize any potentially injurious effect of such variance upon other property in the neighborhood, and to carry out the general purpose and intent of this development code. Prior to the construction of any improvement or the placement of any sign to effectuate an approved variance, a building permit or, ='+ if applicable, sign permit shall first be procured from the city.
