ORDINANCE NO. 5032-90
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE LAND DEVELOPMENT CODE; CREATING A NEW
°t SUBSECTION 136.007(h), CODE OF ORDINANCES, PROVIDING FOR
THE REPAIR OR RECONSTRUCTION OF NONCONFORMING DENSITIES
AND INTENSITIES OF USE IN STRUCTURES LOCATED ON BARRIER
s}} ISLANDS; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Subsection' (h) is added to Section 136.007, Code of
Ordinances, to read:
Sec. 136.007. Nonconformities.
u Nonconforming densities or intensities of use in structures located
on a barrier island. Notwithstanding any other provision of this section, any
structure located on a barrier island within the coastal hazard zone which is
nonconforming due to density or intensity of use but which was in compliance
with all applicable land development regulations at the time of its
construction and which is damaged or destroyed b a storm flood fire or other
catastrophic event, shall be subject to the following:
1 If the structure is damaged such that the cost of repair or
reconstruction to its pre-damage condition is less than fifty 50per cent of
the market value of the structure before the damage occurred, the structure may
be repaired or reconstructed in compliance with subsection c above and shall
not be subject to the reguirements_of chapter 146 relating to flood protection.
,(21 If the structure is damaged such that the cost of reconstruction to
its pre-damage condition equals or exceeds fifty (50) per cent of the mar et
value of the structure before the damage occurred the structure may be
reconstructed in compliance with subsection a above. The project shall be
subject to all applicable development regulations and building code
requirements, including but not limited to the requirements of chapter 146_,
relating to flood protection, with the exception of density or intensity of use
requirements.
L31 An owner who ro oses re air or reconstruction pursuant to this
subsection shall demonstrate that the structure was in compliance with all
applicable regulations at the time of construction.'
