BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 136.029 Code of Ordinances is created to read: Sec. 136.029. Vegetative buffer adjacent to Aquatic Lands-Interior Aquatic Lands-Coastal Districts. s, t Yn . ?r Laj A vegetative buffer, being necessary to protect the ecological and ' aesthetic integrity of interior or coastal wetlands, shall encompass all lands within twenty-five (25) feet of the boundary of any property designated on the zoning atlas as Aquatic Lands-Interior (AL/1) or Aquatic Lands-Coastal r However, this re uiremen?t shal,l_ not apply to existin-g-, seawalls or other •??''><.?>>=Y, structures creating an abrupt transition between the aquatic lands and the rc ?•c adjoining upland property, rx .7 fir. f rg,?'• r When a_pproposed --development is -adjacent to proliertX designated - - - ????_'• err ? . Each day following-the removal or } t alteration of native vegetation shall be deemed a separate violation until the native vegetation is restored. The Code Enforcement Board shall require the owner to restore the vegetative buffer to its natural state at the owners i t?tRt {y??, expense, and the owner shall be subject to the imposition of a fine in an amount :. f?xtGtii3 e ;? ?. it' tift'N?1 not to exceed 100.00 er da for each day that the owner is found to be in ' violation of this section. If prior to the date of adoption of this ordinance the native ve etation within a vegetative buffer has been removed or altered the owner r: shall not be re uired to restore the vegetation to its natural state.
