ORDINANCE NO. 5021-90
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING GAS LINE INSTALLATION AND MAINTENANCE EASEMENTS
LOCATED IN SECTION 30, TOWNSHIP 28 SOUTH, RANGE 16 EAST,
PINELLAS COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has been requested by M.B.C. Corporation, owner of certain
real property located in the City of Clearwater, that the City vacate the
utility easement described herein; and
WHEREAS, the City Commission finds that said easement is not necessary for
municipal use and it is deemed to be to the best interest of the City and the
general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
A 10-foot easement lying 5 feet on each side of the following
described line: Start at the Southwest corner of the Northeast 1/4
of Section 30, Township 28 South, Range 16 East, and run East along
the South line of said Northeast 1/4, 100.0 feet; thence run North
50.0 feet to the Southwest corner of Lot 9, Belle Haven Subdivision,
as recorded in Plat Book 25, Page 52, of the public records of
Pinellas County, Florida; thence continue North along the West line
of said Lot 9, a distance of 79.0 feet, for the POINT OF BEGINNING;
thence run East 126.2 feet; thence North 25.0 feet; thence East 20.6
feet; thence North 101.0 feet to the POINT OF ENDING, less and
except the Partial Release of Gas Line Easement as recorded in O.R.
4755, Pages 317 through 319, of the said public records;
Also, the East 3.0 feet of the West 131.2 feet of the South 74.0
feet of said Lot 9, less and except a portion thereof subordinated
to the State of Florida Department of Transportation as recorded in
O.R. 63.04, Pages 167 through 169, of the said public records.
is hereby vacated, closed and released, and the City of Clearwater quitclaims
and releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon adoption.
