ORDINANCE N0. 5020-90
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ORDINANCE 4996-90, WHICH VACATED THE NORTH-
" SOUTH 5-FOOT UTILITY EASEMENT LYING WEST OF THE EAST LOT
LINE OF LOTS 2 THROUGH 6, MANDALAY SUBDIVISION, TO
INCLUDE A REFERENCE TO BLOCK 54 OF SAID SUBDIVISION IN
ORDER TO CORRECT A SCRIVENER'S ERROR IN THE DESCRIPTION
OF THE EASEMENT; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance 4996-90, adopted on June 21, 1990, vacated a five-foot
utility easement in Mandalay Subdivision, but the description of the easement
failed to include the block number within the subdivision, although it was the
intent of the City Commission to vacate the easement as described in this
amending ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 1 of Ordinance 4996-90 is amended to read:
Section 1. The following:
The North-South 5-foot utility easement lying west of the east lot
line of Lots 2 through 6, Block__- 54:_ Mandalay Subdivision, according
to the plat thereof -as recorded in Plat Book 14, Page 32, of the
public records of Pinellas County, Florida,
is hereby vacated, closed and released, and the City of Clearwater quitclaims
and releases all of its right, title and interest thereto.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption,
Section 3. This ordinance shall take effect retroactively as of June 21,
1990, the effective date of Ordinance 4996-90.
