AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO CLAIMS AND SETTLEMENTS; REPEALING SECTION
24.10, CODE OF ORDINANCES, RELATING TO THE SETTLEMENT
REVIEW AND SMALL CLAIMS COMMITTEE; AMENDING SECTION
24.11, CODE OF ORDINANCES, TO INCREASE THE LIMIT ON THE
SETTLEMENT AUTHORIZATION GIVEN THE CITY MANAGER RELATING
TO CLAIMS ON BEHALF OF AND AGAINST THE CITY; AMENDING
. SECTION 43.05, CODE OF ORDINANCES, RELATING TO PAYMENT
OF CLAIMS AGAINST THE CITY, TO INCREASE THE AUTHORITY
OF THE CITY'S SELF-INSURANCE SERVICE AGENT-TO PAY CLAIMS
FROM FUNDS IN THE BANK TRUST ACCOUNT WITHOUT CITY
COMMISSION APPROVAL; PROVIDING AN EFFECTIVE DATE.
' WHEREAS, Section 24.10, Code of Ordinances, provides for a settlement
' review and small claims committee composed of the safety and insurance
supervisor, an assistant city manager and the city attorney or his designee; and
WHEREAS, the settlement review and small claims committee is not necessary
as a formal committee, and there is some possibility that the committee might
be deemed to be subject to the Florida "government in the sunshine" law; and
WHEREAS, Section 24.11, Code of Ordinances, authorizes the settlement
+ review and small claims committee to settle small claims in favor of and against
the city for amounts not to exceed certain specified limits; and
•J''` WHEREAS, the City Commission finds that the city manager should be

in Section 24.11 as amended by this ordinance; now therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 24.10, Code of Ordinances, is hereby repealed.
Section 2. Section 24.11, Code of Ordinances, is amended to read:

attorney's fees._
