ORDINANCE NO. 4995-90
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO BOATING; AMENDING SECTIONS 114.40, 114.41,
AND 114.42, CODE OF ORDINANCES, TO DESIGNATE CERTAIN
WATER AREAS AS "SLOW DOWN--MINIMUM WAKE" ZONES OR AS
"IDLE SPEED--NO WAKE" ZONES; AUTHORIZING THE POSTING
OF SIGNS IN SUCH AREAS WHEN PERMITTED BY THE FLORIDA
DEPARTMENT OF NATURAL RESOURCES; CREATING SECTION
114.43, CODE OF ORDINANCES, TO PROVIDE AN EXEMPTION FOR
WATERCRAFT OF GOVERNMENTAL AGENCIES; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the establishment of zones for the regulation of the speed of
watercraft is found to be necessary in certain locations because of their size,
shape, or normal watercraft traffic volumes, where hazards to public health and
safety result from the operation of watercraft at excessive speeds; and
WHEREAS, this ordinance is adopted pursuant to the home rule power of the
City of Clearwater, and pursuant to Section 327.60, Florida Statutes, which
reserves to municipalities the power to regulate the operation of vessels
through ordinances not inconsistent with general law; now therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Sections 114.40, 114.41, and 114.42, Code of Ordinances, are
amended to read:

Section 3. This ordinance shall take effect immediately upon adoption.
