RELATING TO WASTEWATER IMPACT FEES, TO CLARIFY THE r1;
INTENT or THE CITY COMMISSION WITH RESPECT TO THE
IMPOSITION OF WASTEWATER IMPACT FEES AT THE RATE OF
$900.00 PER UNIT FOR ALL NEW RESIDENTIAL WASTEWATER
SYSTEM ACCOUNTS, AND ALL EXISTING RESIDENTIAL WASTEWATER `V
SYSTEM ACCOUNTS WHERE CHANGES IN USE OF THE PROPERTY
CAUSE AN INCREASE IN SEWER SERVICE DEMAND; ESTABLISHING ;: .
THAT THE NONRESIDENTIAL RATE FOR A 314 INCH METER IS THE
SAME AS FOR A 518 INCH METER; ESTABLISHING THE TIME FOR
PAYMENT OF THE FEE; PROVIDING AN EXCEPTION; PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Paragraph (3) of Subsectic,n (c) of Section 50.05, Code of
Ordinances, as transferred and amended by Ordinance 4954-90, is further amended
to read:
Sec. 50.05. Deposit, fees, service charges and rate schedules.
(c) Impact fees:
(3) Wastewater impact fees: Payable at the building department at the time
the first building or plumbing uermit is issued upon application for a building
or plumb4ng Permit:
a. Residential accounts:

t. a-r Each nonresidential san4tary sewer account will, for the purpose of
establishing the wastewater impact fee, be considered to comprise a number of
equivalent single-family residential units or "equivalent living units" based
upon the size of the water meter or meters required to serve the account
stipuetura . The wastewater impact fee shall be $900.00 for each equivalent
living unit. Equivalent living units and fees shall be determined according to
the following table:

e. 13`x- Each additional unit o equivalent living unit or part thereof,
occasioned by changes in property usage subsequent to April 1. 1990,, t4*
effeetAye date of this subseetien shall be subject to a wastewater impact fee
computed in accordance with the rates fate set forth in subparagraph a or b,
above, whichever is applicable. If a building permit is issued for an existing
connection which will increase sewer demand, the total number of units or
equivalent living units for the old and new parts of the facility shall be
computed according to the-table set forth i* subparagraph a orb, above. The
number of new units or equivalent living units shall be determined by subtracting
the number of old units or equivalent living units in the entire facility from
the total number of units or equivalent living units. The wastewater impact fee
will be assessed on the remaining number of new units or equivalent living units.
Section 2. Because the purpose of this ordinance is to clarify the intent
of the City Commission in adopting Ordinance 4954-90, and to reconcile Ordinance
4954-90 with its actual implementation, this ordinance shall take effect
retroactively as of April 1, 1990, the effective date of Ordinance 4954-90.
However, as to any development for which a building permit was filed with the
City of Clearwater prior to April 1, 1990, the sewer connection charges in effect
prior to the adoption of Ordinance 4954-90 shall apply in lieu of the wastewater
impact fees established by Ordinance 4954-90.
