ORDINANCE NO. =4965-90 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING
THE NORTH-SOUTH ALLEY LYING WEST OF AND ADJACENT TO LOT
10, BLOCK 3, HARTS 2ND SUBDIVISION TO THE TOWN OF
CLEARWATER, AND AN ALLEY AS SHOWN ON THE PLAT OF FORT
HARRISON SUBDIVISION, PINELLAS COUNTY, FLORIDA; PROVIDING
AN EFFECTIVE DATE.
WHEREAS, it has been requested by Gulf Marine of Clearwater, the
owner of certain real property located in the City of Clearwater, that
the City vacate the right-of-way described herein; and
WHEREAS, the City Commission finds that said right-of-way is not
necessary,.for municipal use and it is deemed to be to the best
interest of the City and the general public that the same be vacated;
now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. The following:
The North-South alley lying West of and adjacent to Lot 10,
Block 3, of Harts 2nd Subdivision to the Town of
Clearwater, as recorded in Plat Book 3, Page 47, of the
public records of Pinellas County, Florida.

Together with the alley as shown on the plat of Fort
Harrison Subdivision, as recorded in Plat Book 26, Page 42,
of the public records of Pinellas County, Florida,
is hereby vacated, closed and released, and the City of Clearwater
quitclaims and releases all of its right, title and interest thereto,
except that the City of Clearwater hereby retains a drainage, utility,
ingress and egress easement over the described property for the
installation and maintenance of any and all public utilities thereon
and for ingress and egress by public service vehicles.
Section 2. The City Clerk shall record this ordinance in the
public records of Pinellas County, Florida, following adoption.
Section 3. This ordinance shall take effect immediately upon
adoption,
