AN ORDINANCE OF THE CITY., OF CLEARWATER, FLORIDA,
VACATING THE FIFTEEN-FOOT NORTH-SOUTH ALLEY IN J. B.
ROBERTS SUBDIVISION, PINELLAS COUNTY, FLORIDA, SUBJECT
TO A DRAINAGE, UTILITY, INGRESS AND EGRESS EASEMENT
WHICH IS RETAINED OVER THE FULL WIDTH THEREOF; PROVIDING
AN EFFECTIVE DATE.

WHEREAS, it has been requested by Morritt Homes, Inc., and the City of
Clearwater, owners of certain real property located in the City of Clearwater,
that the City vacate the right-of-way described herein; and
WHEREAS, the City Commission finds that said right-of-way is not necessary
for municipal use and it is deemed to be to the best interest of the City and
the general public that the same be vacated; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The 15-foot north-south alley in J. B. Roberts -Subdivision,
according to the map or plat thereof, as recorded in Plat Boob 3,
Page 82, of the public records of Hillsborough County, Florida, of
which Pinellas County was once a part,
is hereby vacated, closed and released, and the.City of Clearwater quitclaims
and releases all of its right, title and interest thereto, except that the City
of Clearwater hereby retains a drainage, utility, ingress and egress easement
over the described property for the installation and maintenance of any and all
public utilities thereon and for ingress and egress by public service vehicles.
Section 2. The City Clerk shall record this ordinance in the public
records of Pinellas County, Florida, following adoption.
li Section 3. This ordinance shall take effect immediately upon adoption.
