83-106 e @, ,,' ,'. . .. recommended to the City Commission that the bui'lding situated on the above described property be demolished pursuant to Section 133.02 of the Code of Ordinances of the City of Clearwater, Florida, 198', and the Standard Building Coder and \fHEREAS, the city Commission scheduled a public hearing on said matter for Thursday, October 6, 1983 at 12:30 P.M. at Clear- water City Hall Auditorium, had notice of said public hearing published once a week for at least two weeks, the first publi- cation at least ten days prior, and has alao had mailed a notice of the scheduled public hearing by certified mail, return re- ceipt requested, to the occupant at the street address of the property and the owner of the property addressed as indicated on the current tax roll of pinellas County, Florida, said notice requiring all persons interested to show cause why the occupant or owner, or both, should not comply with the order and decision of the Building Officia1f NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 'THE CITY OF CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS: 1. The City commission, after proper notice and public hear- ing, and having considered the evidence and testimony presented, finds that no objections have been filed or presented or that the objections filed or presented are deemed insufficient, further finds that the above described real property and the building situated thereon are unsafe, unsanitary, unfit for human habitation'and dangerous and detrimental to the health, safety, morals and general welfare of the community, and do not properly comply with the requirements of section 133.02 of the Code of Ordinances of the City of Clearwater, Florida, 19B~, relating to unsafe buildings, and the Standard Building Code. 2. Further, that the city Commission does hereby agree and concur with and in the finding and determination of the Building Official of the City of Clearwater as set forth in the Building Official's notice contained in Exhibit A attached hereto and made a part herein concerning said real property and the building thereon and the owners, or agent of the owners, are ordered -2- Res. 83..106 10-20-83 '. ;' : ~ ~ . ,:';';'r.:~".. '1 . @ @,..,- ".\f" 'K.! . . . within thirty (30) days after the passage and adoption of this Resolution to removo or demolish such building in accordance with the roquirements of the Standard Building Code as referred to in Section 133.02 of the Codo of Ordinances of the; City of Clearwater, Florida, 1983. 3. That a certified copy of this Resolution shall be immediately fon~arded by certified mail, return receipt requested, to the occupant, if any, at the street address of the property, and to the owners of the property addresses as indicated on the current tax roll of pinellas County, Florida. 4. Further, that if said occupant and/or owners fail to properly comply with this Resolution within the said thirty (30) day period, the City Commission shall cause the removal or demolition of said building and shall charge upon those benefitted and the property such special assessment of the necessary ccsts incurred as determined by the City Commission and shall provide that such assessment be a lien upon the real estate improved.
