WHEREAS, the City Commission of the City of Clearwater, Florida,
through the adoption of Resolution No. 79-102, declared the tract of land
identified in the resolution as surplus property and authorized exchange
of the property with PACT, Inc. ; and
WHEREAS, since the time of such exchange, in proceeding with
the development it has been ascertained that because of the existence of
a group of oak trees, a slight shifting in the building as depicted on the
site plan has become necessary; and
WHEREAS, such change has made necessary a change irk one of
the calls contained in the description set out in Resolution No. 79-102; and
WHEREAS, amending that description to modify the call will not
change the overall 4.24 acre tract which was declared surplus;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That paragraph one (1) of Resolution No. 79-102, adopted
by the City Commission of the City of Clearwater, Florida, on November
15, 1979, be and the same is hereby amended to modify the legal description
as follows;
That certain piece, parcel, or tract of land lying in and
being part of the North half of Section 9, Township 29 South,
Range 16 East, Pinellas County, Florida, being more
particularly described as follows:
From the center of said Section 9, N 00°0714311 E, and along
the North-South centerline of said Section 9, a distance of
163r3A 94. 50 feet for a point of beginning; thence N 89°21'
0811 W, and parallel with the East-West centerline of said
Section, a distance of 268.80 feet; thence N 00.07143" E,
and parallel with the North-South centerline of said Section,
a distance of 377.60 feet; thence S 89°21'08" E, and parallel
with the East-West centerline of said Section, a distance of
489.60 feet; thence S 00°071431' W, and parallel with the
North-South centerline of said Section, a distance of 377.60
feet; thence N 89°21'0811 W, and parallel with the East-West
centerline of said Section, a distance of 220.80 feet to the
North-South centerline of said Section and the Point of
Beginning; containing 4.24 acres, more or less.
