A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA, ASSES-
SING THE OWNERS OF PROPERTY THE COSTS OF
HAVING MOWED OR CLEARED THE OWNER'S LOT,
WHEREAS, it has been determined by the City Commission
of the City of Clearwater, Florida, through the passage of
Ordinance No. 1894 that for the purpose of promoting the health,
safety and general welfare of the citizens and residents of the
City of Clearwater, lots, parcels or tracts of land within the
corporate limits of the City of Clearwater, Pinellas County,
Florida, such as described below should be cleared of weeds,
rubbish, debris and other noxious material; and
WHEREAS, notice pursuant to Section 23B-7 of the Code
of Ordinances was provided to the owner of each of the lots
listed below that such lot was in violation of Chapter 23B - the
Lot Clearing Code; and
WHEREAS, pursuant to Section 23B-7 of the Code of
Ordinances, following the expiration of ten'(10) days from the
date of each notice but not less than fifteen (15) days after
such'notice a further hearing was held for the City Commission
of the City of Clearwater, Florida, with notice of such hearing
being provided to each property owner listed below to attend
and present evidence relating to why the Jot should not be
cleared or mowed by the City; and
WHEREAS, the City Commission pursuant to Section 23B-9
of the Code of Ordinances has authorized each of the lots listed
below to be cleared by the City and the actual costs of clearing
or mowing plus administrative costs, to be assessed against
each property owner.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER; FLORIDA
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

ing the hearing the City Commission pursuant to Section 23B-9

part hereof after notice'to each property owner were considered
at a public hearing held November 6 and November 20, 1980
with the question being should each lot be cleared or mowed
by the City and the costs including administrative costs
authorize the City to clear or mow each lot.
1'"r 2. That pursuant to Section 23B-13 of the Code of
Ordinances the owner of each lot listed on Exhibit A has been
provided with a notice and opportunity, thirty (30) days,
within which to pay the costs and administrative charges set
forth on Exhibit A but no payments have been received.
3. That each lot listed on Exhibit A, having been
cleared or mowed by the CitY, the City Commission pursuant to
?'. Section 23B-11 of the Code of Ordinances hereby assesses a
lien on behalf of the City of Clearwater against each parcel

shown on Exhibit A for the actual costs of mowing or clearing
s shown on the Exhibit plus administrative costs.
4. That the City Clerk is hereby directed to pre-
pare a notice of'lien against each property -listed on Exhibit A
and to file the same in the Office of the Clerk of the Circuit
Court of Pinellas County, Florida.
5. That this resolution shall become effective
}ter immediately upon its adoption.
