WHEREAS. the City of Clearwater has a nature center oriented
park now being developed, commonly known as Moccasin Lake Park; and
\mnREAS. the City of Clearwater desires to develop an outdoor
nature appreciation and energy conservation demonstration project in
Moccasin Lake Parkj and
lmEREAS, the Flori da Oep nrtmen t of Na turn! Res ources , Divis ion
of Recreation and Parks, has offered a grant award in response to the
City proposal for the Moccasin Lake Energy Center, such proposal autho-
rized by City Resolution 80-67 and known as Land and Water Conservation
Fund project number 12-00178, and it is necessary to accept such award
and to execute appropriate documents;
NOW. THEREFORE, BE IT RESOLVED BY THE CITY
CO~WISSION OF THE CITY OF CLEARWATER, FLORIDA
IN SESSION DULY AND REGULARLY ASSE~mLED, AS
FOLLOWS:
1. That the City of Clearwater accepts the Land and Water
Conservation Fund Program Grant from the Florida Department of Natural

Any portion of these funds may be released in installments, at the
CITY
discretion of the"DEPARTMENT, upon the ~equest of the
commissioners or the
CITY'S
duly authbrized agent, whose name
and title shall be submitted to 'the DEPARTHE~tT prior to commence-
ment of the ,project.
Such requests shall be limited'to three (3)
in number anc each request shall include all documentation required
bj. the DEPARTMENT.
The DEPART~NT shall be noti=ied for~hwith 0=
any change in the person or authority of the designated agent.
6. 'This agreement shalY take effect on . February 5. 1981 ,
and shall terminate on
December 31, 1981
In .the event the
CITY
fails to develop the subj,ect property in 'a
manner described in this agreement, on or befor~ December 31, 1981,
the

agrees that upon demand it will return to ~'e

Any waiver by the DEP~~TME~T for cause shown, and extension 0: the

8.

The
CITY
described in Exhibit "B" and by its acceptance of the provisions
of this agreement does hereby dedicate the land described in
Exhibit "B" to the public in 'perpetuity as a recreation area avail-
able to the general public for recreational purposes only. The

by the,Executive ~irector of the Department of Natural Resources
shall constitute an acceptance of the dedication on behalf of the
general public of the State.
Thereafter, should the

for any reason convert all or any portion of. the property described
in Exhibit "Bn to other than recreational purposes, the

agrees to provide at its sole expense without further contribution
from the Land and Water Conservation Fund a replacement project
of comparable quality and size to that which was converted to'
other pu.-poses, which replacement shall be in close proximity to
